other instrument creating the trust shall be considered
as a single trust. After any shares have been set apart
or divided, to be held in separate trust, each separate
trust set apart shall be considered as a single trust.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.

AN ACT concerning

Merit System — Unique Class of Employees

FOR the purpose of providing that if a class is unique to
one agency, the Secretary of Personnel may permit
the agency to recruit, examine and certify a list of
eligible persons to be considered for appointment to
that unique class.

BY repealing and reenacting, with amendments,

Article 64A - Merit System

Section 17 (a)

Annotated Code of Maryland

(1972 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 17(a) of Article 64A - Merit
System, of the Annotated Code of Maryland (1972
Replacement Volume and 1975 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows:

Article 64A — Merit System

17.

(a) Whenever a vacancy in any position in the
classified service is to be filled, the appointing
authority shall make requisition upon the Secretary of
Personnel for eligibles. The Secretary shall thereupon
certify to the appointing authority the names and
addresses of the five persons standing highest upon the
eligible list for the class in which the position is
found, or if there be less than five, then such name or
names as may be on such list, and said appointing
