(b) [Except for the positions of Commissioner,
Correctional Director, Industries Director, warden,
superintendent, assistant warden, and assistant

superintendent all officers and employees of the
Department are members of the classified service provided
for in Article 64A of this Code.] EXCEPT FOR THE
POSITIONS OF COMMISSIONER, DEPUTY COMMISSIONER, ASSISTANT

COMMISSIONER, INDUSTRIES GENERAL MANAGER, CHAPLAIN,

WARDEN, SUPERINTENDENT, ASSISTANT WARDEN, AND ASSISTANT

SUPERINTENDENT, ALL OFFICERS AND EMPLOYEES OF THE

DEPARTMENT SHALL BE APPOINTED AND REMOVED BY THE

DEPARTMENT IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE
64A. The warden or superintendent of each institution is
the appointing officer for employees of that institution,
and the Commissioner is the appointing officer for all
other employees in the Department.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.

AN ACT concerning

Medical Assistance Recipients — Claims Against Estates

FOR the purpose of authorizing the Department of Health
and Mental Hygiene to make claim against the Estate
of an indigent or medically indigent person for the
amount of medical assistance payments that the
Department made on his behalf or her behalf under
certain conditions.
