except that spices, flavorings, and colorings, other than
those sold as such, may be designated as spices,
flavorings, and colorings without naming each, EXCEPT
THAT RED DYE #2 SHALL BE NAMED; PROVIDED, HOWEVER, THAT
THE FOODS WHICH CONTAIN RED DYE #2 WHICH HAVE BEEN
SHIPPED BY THE MANUFACTURER TO THE WHOLESALE OR RETAIL
DISTRIBUTOR ON OR BEFORE THE EFFECTIVE DATE OF THIS ACT
SHALL BE EXEMPT FROM THE REQUIREMENT OF NAMING RED DYE #2
AND provided, however, that to the extent that compliance
with the requirements of clause (ii) of this subsection
is impractical or results in deception or unfair
competition, exemptions shall be established by
regulations promulgated by the Secretary.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.

(House Bill 585)

AN ACT concerning

Division of Correction — Personnel

FOR the purpose of repealing certain provisions regarding
correctional personnel which were made obsolete by
the reorganization of the Division of Correction,
and clarifying which positions within the Division
are to be appointed and removed in accordance with
the provisions of the Merit System.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 684(b) of Article 27 - Crimes and
Punishments, of the Annotated Code of Maryland (1971
Replacement Volume and 1975 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows:
