BY repealing and reenacting, with amendments,
Article 64A — Merit System
Section 19
Annotated Code of Maryland
(1972 Replacement Volume and 1975 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 19 of Article 64A - Merit System,
of the Annotated Code of Maryland (1972 Replacement
Volume and 1975 Supplement) be and it is hereby repealed
and reenacted, with amendments, to read as follows:
Article 64A - Merit System
19.
No person who has been [heretofore or who shall
hereafter be] convicted of any crime [,] and who [shall
have] HAS served his sentence or [shall have] HAS
obtained his release by virtue of any pardon, full or
conditional, on probation or release by conditional
commutation of sentence, or by parole, shall be rendered
ineligible, if otherwise qualified, by reason of [said]
THE conviction, to take the examination mentioned in § 18
of this article [; provided, however, that no person
convicted of crime shall be entitled to the preference
given to veterans and that if]. NO PERSON WHO HAS
RECEIVED AN HONORABLE DISCHARGE FROM THE MILITARY OR
NAVAL SERVICES OR WHO HAS RECEIVED A CERTIFICATE OF
SATISFACTORY COMPLETION OF SERVICE AND WHO IS THEREAFTER
CONVICTED OF A [[FELONY]] CRIME MAY BE ENTITLED TO THE
PREFERENCE GIVEN TO VETERANS. HOWEVER, IF any such
person is, after the taking of any such examinations,
certified by the Secretary of Personnel as eligible for
appointment to any position, the appointing authority may
consider the [aforesaid] conviction in determining
whether such person shall be given the appointment for
which an eligible list has been requested.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
