Ch. 617

Dorchester, Garrett, Harford, Kent, Montgomery, Somerset,
[Wicomico] and Worcester counties, in all of which
jurisdictions such licenses shall not be issued.

1 9.

(l-1) (3) [Such a] THIS license may be issued in
Wicomico County to a restaurant which [meets the
following requirements and conditions: (i) ] is a business
establishment for the accommodation of the public, fully
equipped with a proper and adequate dining room[, tables,
chairs, and sufficient facilities for preparing and
serving full—course regular meals at least twice daily,
wherein the patron is offered a general choice of several
varied types of food for a main course and supplemental
extra foods; (ii) has a regular seating capacity at
tables (not including seats at bars or counters) for
seventy—five or more persons seated comfortably and
adequately; (iii) serves alcoholic beverages only during
or in connection with meals, with patrons seated at
tables or at bars or counters; (iv) during the effective
period of the license has daily average receipts from the
sale of food in excess of those for the sale of alcoholic
beverages; (v) has an applicant or applicants for the
license who has or have been a bona fide resident or
residents of Wicomico County for not less than five years
immediately preceding the filing of the application, and
who has or have been a registered voter or voters of
Wicomico County for not less than one year immediately
preceding the filing of the application; (vi) contains
sanitary facilities, running hot and cold water,
equipment for the proper cleaning of dishes and
kitchenware, and adequate toilets, as approved by the
board of license commissioners and the county health
department; (vii) has at all times sufficient food on the
premises for the regular serving of meals; (viii) has a
proper sign or signs in front of the establishment
designating "restaurant" and not advertising any other
business. This license permits sales at bars or counters
to seated patrons only and does not permit sales for
consumption anywhere except inside the building. Before
such a license is issued or renewed the board of license
commissioners shall make a physical inspection of the
proposed licensed premises and shall satisfy themselves
of the moral character, financial responsibility, and
adequacy of investment of the applicant, the
appropriateness of the location and suitability of design
of the building where the licensed business is to be
conducted, taking into consideration the number of
licenses already issued, and generally as to the
applicant's fitness to engage in the business] WITH
FACILITIES FOR PREPARING AND SERVING REGULAR MEALS,
WHEREIN THE AVERAGE DAILY RECEIPTS FROM THE SALE OF FOODS
EXCEED THE AVERAGE DAILY RECEIPTS FROM THE SALE OF
ALCOHOLIC BEVERAGES.
