Article 77 - Public Education
36.
[ (b) Nomination for membership on the county Board
of Education of Montgomery County, except as otherwise
herein provided, shall be by petition endorsed by a
minimum of 500 voters of the county. Each such petition
shall be filed with the board of election supervisors of
Montgomery County not later than the deadline prescribed
for other candidates for public office as set forth in
Article 33, § 44—3 of this Code. Each such petition
filed shall be accompanied by a $25.00 filing fee.
Except as otherwise in this section specified, each such
petition shall conform generally to the laws and
requirements of Article 33 of this Code, provided,
however, that publication of each such petition shall not
be required.
(1) If after the expiration of the time
allowed for filing of petitions by this section, there
are no more than two nominees for the county Board of
Education at large, respectively for each member then to
be elected, said board of supervisors of elections shall
certify said candidates as duly nominated candidates for
election for the respective Board of Education offices.
These names and the name of the position for which they
are candidates shall be omitted from the ballot required
by sub—subsection (2) of this subsection.
(2) If after the expiration of the time, as
aforesaid, there are more than two nominees for the
county Board of Education at large, respectively for each
member then to be elected, said board of supervisors of
elections shall provide the means whereby all duly
registered voters of Montgomery County, irrespective of
party affiliation, may vote for said nominees for the
county Board of Education at a primary election to be
held at the time and place for holding the primary
elections of the political parties. In taking the
ballot, voting machines shall be used, except for any
election at which the use of electronically tabulated
punchcard ballots has been authorized by the State
Administrative Board of Election Laws pursuant to article
33, section 16A—1, of this code; provided, however, that
if the number of candidates submitted for vote at the
primary elections is too large for the practical use of
voting machines, the said board of supervisors of
elections shall supply paper ballots in the usual form
for use in voting for such offices. A duly registered
voter may vote for not more than the number of nominees
for which there are offices to fill. The eight persons
among those whose names are duly placed on primary
ballots as candidates for nomination to the county Board
of Education at large, in those years when elections
shall be held for four members at large to the county
Board of Education and six persons among those whose
names are duly placed on primary ballots as candidates
