DOCUMENT DOES NOT AFFECT THE VALIDITY OF ANY OF ITS OTHER
PROVISIONS UNLESS THE REMAINING VALID PROVISIONS ALONE
ARE INCOMPLETE AND INCAPABLE OF BEING EXECUTED IN
ACCORDANCE WITH THE REGULATORY INTENT.

SECTION 4. AND BE IT FURTHER ENACTED, That Section
256R of Article 41 — Governor — Executive and
Administrative Departments, of the Annotated Code of
Maryland (1971 Replacement Volume and 1975 Supplement) be
and it is hereby repealed and reenacted, with amendments,
to read as follows:

Article 41 - Governor - Executive and Administrative

Departments

256R.

[(a)] The publication of any document in the Code of
Maryland Regulations[, the permanent supplement,] or the
Register creates a rebuttable presumption:

(1)        That it was duly issued, prescribed,
repealed, or adopted;

(2)        That it was approved as to legality by
the Attorney General, if the document is an agency rule;
and

(3)        That all requirements of this subtitle
have been complied with.

[(b) Any document published pursuant to this
subtitle is admissible as evidence in any court
proceeding, if otherwise relevant and material.]

SECTION 5. AND BE IT FURTHER ENACTED, That Section
10-203(a)(2) of Article - Courts and Judicial

Proceedings, of the Annotated Code of Maryland (1974
Volume and 1975 Supplement) be and it is hereby repealed
and reenacted, with amendments, to read as follows:

Article - Courts and Judicial Proceedings

10-203.

(a) [(2) A rule, regulation, or bylaw of an
agency subject to the provisions of Article 41, §9 of the
Code shall be judicially noticed or read in evidence from
the printed volumes of the copy filed in the Court of
Appeals if the agency has complied with the provisions of
Article 41, § 9.]

(2) THE CONTENTS OF THE MARYLAND REGISTER
AND THE CODE OF MARYLAND REGULATIONS SHALL BE JUDICIALLY
NOTICED FROM THE OFFICIAL TEXT OF THOSE PUBLICATIONS.
