[(b) Any amendment of the document shall be drawn
as an amendment to the official text.
(c) (1) If a discrepancy is found between the
official text and any other text, the agency or person
responsible for filing the document under § 256—I may
file the appropriate corrective amendment to the official
text of the document he submitted with the administrator,
notwithstanding the requirements of § 256—I. The
amendment shall be effective as of the effective date of
its publication.
(2) If there is a discrepancy between the
official text and the agency text of a document, and the
corrective amendment would change the legal effect of the
document, then the provisions of § 256—I are applicable.
(3) If there is a discrepancy between the
official text and any subsequent printing in the
permanent supplement or Code of Maryland regulations, the
administrator shall amend the section appropriately and
transmit the correction to the printer. In this case,
the effective date of the amendment is the effective date
of the official text.
(d) The administrator may correct minor printing
or editorial errors by the publication of an errata list
in the Maryland Register if the legal effect of a
document is not changed. The correction does not change
the effective date of the official text. ]
SECTION 3. AND BE IT FURTHER ENACTED, That new
Section 256M—1 be and it is hereby added to Article 41 —
Governor - Executive and Administrative Departments, of
the Annotated Code of Maryland (1971 Replacement Volume
and 1975 Supplement) to read as follows:
Article 41 — Governor — Executive and Administrative
Departments
256M-1.
(A) SUBJECT TO SUBSECTION (B) OF THIS SECTION, THE
ADMINISTRATOR SHALL CORRECT ERRORS IN THE OFFICIAL TEXT
OF A DOCUMENT AS PUBLISHED IN THE REGISTER OR THE CODE OF
MARYLAND REGULATIONS BY THE PUBLICATION OF AN ERRATA LIST
IN THE REGISTER OR BY PUBLICATION OF THE DOCUMENT OR THE
AFFECTED PART OF THE DOCUMENT IN ITS CORRECTED FORM.
(B) CORRECTION OF AN ERROR CHANGING THE LEGAL
EFFECT OF A PROPOSED OR ADOPTED RULE OR PROPOSED
AMENDMENT TO A RULE AS PUBLISHED IN THE REGISTER SHALL BE
MADE IN ACCORDANCE WITH § 256-I OF THIS SUBTITLE.
(C) THE PROVISIONS OF A DOCUMENT ARE SEVERABLE
UNLESS THE DOCUMENT EXPRESSLY STATES THAT THE PROVISIONS
ARE NOT SEVERABLE. AN ERROR IN PUBLICATION OF A DOCUMENT
THAT CHANGES THE LEGAL EFFECT OF A PROVISION OF THE
