SECTION 2. AND BE IT FURTHER ENACTED, That new
Sections 1(a), 14(a), 28, 29, 30, 31, 32, 32A, 32B, 32C,
65, and 74(e) be and they are hereby added to Article 77A
- Higher Education, of the Annotated Code of Maryland
(1975 Replacement Volume and 1975 Supplement) to read as
follows:

Article 77A — Higher Education

1.

(A) THERE IS A BOARD OF COMMUNITY COLLEGE TRUSTEES
IN EACH COUNTY HAVING A COMMUNITY COLLEGE AND IN
BALTIMORE CITY. THE BOARDS SHALL BE APPOINTED AS
PROVIDED IN THIS ARTICLE. IF THE GOVERNMENT OF A COUNTY
NOT HAVING A COMMUNITY COLLEGE DESIRES TO CREATE A
COMMUNITY COLLEGE IN THE COUNTY, IT SHALL NOTIFY THE
STATE BOARD FOR HIGHER EDUCATION, THE STATE BOARD FOR
COMMUNITY COLLEGES AND THE GOVERNOR OF ITS DESIRE. UPON
THE RECOMMENDATION OF THESE BOARDS, THE GOVERNOR SHALL
APPOINT A BOARD OF COMMUNITY COLLEGE TRUSTEES FOR THE
COUNTY. SUBJECT TO THE PROVISIONS OF §§ 8, 31, 32, AND
32A OF THIS ARTICLE, THE BOARDS OF COMMUNITY COLLEGE
TRUSTEES, WITH THE APPROVAL OF THE STATE BOARD FOR HIGHER
EDUCATION, ACTING UPON THE RECOMMENDATION OF THE STATE
BOARD FOR COMMUNITY COLLEGES, MAY ESTABLISH AND MAINTAIN
ONE OR MORE COMMUNITY COLLEGES IN THEIR RESPECTIVE
SUBDIVISIONS AND EXERCISE THE FOLLOWING POWERS:

(E) THE POWERS AND AUTHORITY GRANTED TO THE BOARD
OF TRUSTEES UNDER THIS SECTION AND UNDER SECTIONS 14B
THROUGH 14K ARE SUBJECT TO THE PROVISIONS OF SECTIONS 31,
32, AND 32A OF THIS ARTICLE.

28. CREATION; COMPOSITION; TERMS; COMPENSATION.

(A)    THERE IS A STATE BOARD FOR HIGHER EDUCATION.
IT CONSISTS OF 11 PERSONS APPOINTED BY THE GOVERNOR WITH
THE ADVICE AND CONSENT OF THE SENATE. THESE PERSONS MAY
NOT BE EMPLOYED BY, OR BE MEMBERS OF THE GOVERNING OR
ADVISORY BOARDS OF, ANY AGENCY OR ANY INSTITUTION OF
POSTSECONDARY EDUCATION IN THE STATE SUBJECT TO THE
BOARD'S JURISDICTION DURING THEIR TERM OF MEMBERSHIP ON
THE BOARD.

(B)    THE TERMS OF THE MEMBERS ARE FIVE YEARS.
HOWEVER, OF THE INITIAL APPOINTEES, THREE SHALL RECEIVE
AN INITIAL TERM OF FIVE YEARS; TWO SHALL RECEIVE AN
INITIAL TERM OF FOUR YEARS; TWO SHALL RECEIVE AN INITIAL
TERM OF THREE YEARS; TWO SHALL RECEIVE AN INITIAL TERM OF
TWO YEARS; AND TWO SHALL RECEIVE AN INITIAL TERM OF ONE
YEAR. MEMBERS ARE ELIGIBLE FOR REAPPOINTMENT; HOWEVER, A
PERSON MAY NOT SERVE MORE THAN TWO FULL FIVE YEAR TERMS
AS A MEMBER OF THE BOARD.
