SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 1(a), 7A, 9(a), (b), and (c), 28,
29, 30, 31, 32, and 65 of Article 77A - Higher Education,
of the Annotated Code of Maryland (1975 Replacement
Volume and 1975 Supplement) be and they are hereby
repealed:

Article 77A — Higher Education

1.

[ (a) The board of education of any county and the
Board of School Commissioners of Baltimore City, and
until June 30, 1969, with the approval of the State
Superintendent of Schools, by appropriate resolution, may
establish and maintain community colleges. From and
after July 1, 1969, the approval shall be that of the
State Board for Community Colleges. For the purposes of
administration over these colleges the board of education
shall constitute a board of trustees and governmental
corporation; provided, however, that the board of
education may, upon appropriate resolution and in
accordance with the procedure set forth in § 9 of this
subtitle, transfer its authority and rights under this
section to a board of trustees established by § 9 of this
subtitle, shall be vested with the following powers:]
