FOR the purpose of permitting the Secretary of Personnel
to approve certain requests under certain conditions
for compensation for unused annual leave.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 37(d) of Article 64A - Merit
System, of the Annotated Code of Maryland (1972
Replacement Volume and 1975 Supplement) be and it is
hereby repealed:

[ (d) The head of any department shall have
authority to compensate at the regular rate of pay any
employee for any days of extra service rendered by reason
of any vacation or weekly leave which he may waive,
beginning January 1, 1942, when funds are available for
making such payments.]
SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 37(d) be and it is hereby added to Article 64A -
Merit System, of the Annotated Code of Maryland (1972
Replacement Volume and 1975 Supplement) to read as
follows:

37.
(D) THE HEAD OF ANY DEPARTMENT MAY REQUEST THE
SECRETARY OF PERSONNEL TO APPROVE COMPENSATION FOR AN
EMPLOYEE, WHEN FUNDS ARE AVAILABLE, AT THE REGULAR RATE
OF PAY, FOR ANY ANNUAL LEAVE DAYS IN EXCESS OF THE
MAXIMUM AMOUNT ALLOWED UNDER THE LAW WHICH THE EMPLOYEE
HAS BEEN DENIED THE OPPORTUNITY TO ACCUMULATE OR USE.
THE SECRETARY OF PERSONNEL MAY APPROVE REQUESTS FOR
COMPENSATION OF UNUSED ANNUAL LEAVE DAYS ONLY WHEN THOSE
REQUESTS ARE ACCOMPANIED BY WRITTEN DOCUMENTATION
PRESENTED BY THE REQUESTING DEPARTMENT HEAD OUTLINING THE
