SECTION AND HE OBTAINS A HUNTER'S LICENSE. However, the
Department may not require a [person hunting wild
waterfowl from a gunning rig] LICENSE FOR A GUNNING RIG
USED in an area protected by [his] A RESIDENT'S licensed
blind site [to obtain a gunning rig license].
(b) A [person] RESIDENT may apply for a gunning
rig license to the clerk of the Circuit Court of the
county in which the gunning rig is kept or moored when
not in use during the hunting season. Each applicant
shall certify that he is a resident of the State and that
he will comply with the federal and State laws and rules
and regulations controlling the hunting of wild
waterfowl. If two or more residents own the same rig,
all parties shall sign the application.
(f) In addition to any other penalty provided by
the provisions of this title, the Secretary, any Natural
Resources Police Officer, or any law enforcement officer
may confiscate the license of any [person who uses it
unlawfully or who violates] GUNNING RIG THAT IS USED
UNLAWFULLY OR IN VIOLATION OF the certification under
which it is issued.

(A) A person may not use a licensed gunning rig
measuring less than 16 feet in length or 20 inches in
height, at the lowest point, in the following waters:
(1) The Susquehanna Flats as defined in §
10-623.
(2) The Elk and Sassafras rivers in Cecil
County.
(3) THE CHINCOTEAGUE BAY, SINEPUXENT BAY,
ISLE OF WIGHT, ASSAWOMAN BAY AND THEIR RESPECTIVE
TRIBUTARIES IN WORCESTER COUNTY.
SECTION 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
