AN ACT concerning

Commercial Law — Implied Warranty of Merchantability

FOR the purpose of expanding the implied warranty of
merchantability to leased products.

BY adding to

Article — Commercial Law

Section 2-314(4)

Annotated Code of Maryland

(1975 Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 2-314(4) be and it is hereby
added to Article — Commercial Law, of the Annotated Code
of Maryland (1975 Volume and 1975 Supplement) to read as
follows:

(4) SUBSECTIONS (1) AND (2) OF THIS SECTION
APPLY TO A LEASE OF GOODS AND A BAILMENT FOR HIRE OF
GOODS THAT PASS THROUGH THE PHYSICAL POSSESSION OF AND
ARE MAINTAINED BY THE LESSOR, SUBLESSOR, OR BAILOR.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
