FOR the purpose of specifying the powers of charter
counties to enact laws for historic and landmark
zoning and preservation.

BY repealing and reenacting, with amendments,

Article 25A — Chartered Counties of Maryland

Section 5(BB)

Annotated Code of Maryland

(1973 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 5(BB) of Article 25A - Chartered
Counties of Maryland, of the Annotated Code of Maryland
(1973 Replacement Volume and 1975 Supplement) be and it
is hereby repealed and reenacted, with amendments, to
read as follows:

Article 25A - Chartered Counties of Maryland

The following enumerated express powers are granted
to and conferred upon any county or counties which
hereafter form a charter under the provisions of Article
11A of the Constitution, that is to say:

(BB) Historic and Landmark Zoning and Preservation

To enact laws generally for historic and
landmark zoning and preservation; TO ENACT THOSE LAWS IN
ACCORDANCE WITH THE PROVISIONS OF ARTICLE 66B, SECTION
8.01 ET. SEQ., OR TO ENACT SUCH LAWS TO BE ADMINISTERED
GENERALLY BY AN HISTORIC DISTRICT COMMISSION [[APART FROM
THE ADMINISTRATION OF THE COUNTY'S GENERAL ZONING AND
PLANNING LAW]] AND TO PROVIDE FOR APPEALS. THE
AUTHORITY CONFERRED BY THIS SUBSECTION SHALL BE IN
ADDITION TO ANY EXISTING CHARTER PROVISIONS OR LOCAL LAW
PROVIDING FOR PLANNING AND ZONING.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
