paragraph (c), § 491 of this subtitle; or who shall use
large display or glaring light signs;

(h) Any person against whom charges, upon which a
revocation or suspension of his or her certificate may be
based have been made, shall be notified of the fact and a
copy of the charges shall be sent him or her by the Board
of Podiatry Examiners, and such shall be given a fair and
impartial trial by the said Board of Podiatry Examiners
whose decision shall be made by a majority of said Board
of Podiatry Examiners. Any person aggrieved by a
decision of the said Board of Podiatry Examiners may
appeal from such decision to the circuit court in the
county in which the name of such person is registered, or
if such resides in Baltimore City, to the Circuit Court
of Baltimore City. ]

(A)    (1) THE BOARD MAY INVESTIGATE ANY COMPLAINT
ALLEGING THAT A PODIATRIST PRACTICING IN THIS STATE HAS
COMMITTED ANY OF THE VIOLATIONS ENUMERATED IN SUBSECTION
(B) OF THIS SECTION.

(2)          THE BOARD MAY SUBPOENA WITNESSES,

RECORDS, AND      MATERIALS PERTINENT TO THE INVESTIGATION.

THE BOARD MAY      ADMINISTER OATHS TO PERSONS TESTIFYING
BEFORE IT.

(B)    AFTER ITS INVESTIGATION, THE BOARD, BY A
MAJORITY OF ALL OF ITS MEMBERS, MAY CHARGE A PODIATRIST
ON ANY OF THE FOLLOWING CAUSES:

(1)    CONVICTION OF A CRIME THAT INVOLVES
MORAL TURPITUDE;

(2)    ADDICTION TO NARCOTICS, HABITUAL
DRUNKENNESS, OR WHILE SUFFERING FROM A CONDITION,
ILLNESS, OR DISEASE THAT MAY AFFECT HIS PROFESSIONAL
COMPETENCE, RENDERING OF PROFESSIONAL SERVICES;

(3)    PERSONAL USE OR PRESCRIPTION OR
DISTRIBUTION TO ANY OTHER PERSON OF A CONTROLLED
DANGEROUS SUBSTANCE IN VIOLATION OF THE LAW;

(4)    FRAUDULENT, IMMORAL, OR UNPROFESSIONAL
CONDUCT IN PRACTICE AS A PODIATRIST;

(5)    ABANDONMENT OF A PATIENT;

(6)    WILFUL MAKING AND FILING OF A FALSE
REPORT OR RECORD OF PROFESSIONAL SERVICES RENDERED;

(7)    WILFUL OMISSION OR FAILURE TO FILE OR
RECORD OR WILFUL IMPEDIMENT OR OBSTRUCTION OF THE FILING
OR RECORDING OF A MEDICAL REPORT REQUIRED BY LAW;

(8)    DIVISION OF FEES OR AGREEMENT TO PAY ANY
SUM OF MONEY TO ANOTHER PERSON FOR REFERRING OR BRINGING
A PATIENT INTO THE PRACTICE;
