Health] Department OF HEALTH AND MENTAL HYGIENE and shall
include: (1) the date [and], type AND RESULTS of the test
performed[, the results of such test, the case number,];
(2) THE NAME, age, sex, and [political subdivision of
residence] ADDRESS of the person from whom the specimen
was obtained[,]; and (3) the name and address of the
physician for whom [such] THE examination was
performed.]]

(D) (1) WITH RESPECT TO REPORTS OF TESTS OF

EVIDENCE OF GONORRHEA__AND SYPHILIS ONLY, EACH REPORT

SHALL BE IN WRITING ON A FORM PROVIDED BY THE DEPARTMENT

OF HEALTH AND MENTAL HYGIENE AND SHALL INCLUDE: (I) THE

DATE, TYPE, AND RESULTS OF THE TEST PERFORMED, AND THE

CASE NUMBER; (II) THE AGE, SEX, AND POLITICAL SUBDIVISION
OF RESIDENCE OF THE PERSON FROM WHOM THE SPECIMEN WAS
OBTAINED; AND (III) THE NAME AND ADDRESS OF THE PHYSICIAN
FOR WHOM THE EXAMINATION WAS PERFORMED.

(2) WITH RESPECT TO REPORTS OF TESTS__OF

EVIDENCE OF THE OTHER DISEASES ENUMERATED IN SUBSECTION
(B) OF THIS SECTION, EACH REPORT SHALL BE IN WRITING ON
A FORM PROVIDED BY THE DEPARTMENT AND SHALL INCLUDE: (I)
THE DATE, TYPE, AND RESULTS OF THE TEST PERFORMED; (II)
THE NAME, AGE, SEX, AND ADDRESS OF THE PERSON FROM WHOM
THE SPECIMEN WAS OBTAINED; AND (III) THE NAME AND ADDRESS
OF THE PHYSICIAN FOR WHOM THE EXAMINATION WAS PERFORMED.

[(c)] [[(D)]](E) [The] ALTHOUGH THE result of the
laboratory examination MAY BE AN ESSENTIAL AID TO
DIAGNOSIS, IT does not constitute a final diagnosis [of
syphilis or gonorrhea. However, it is an essential aid
in the diagnosis of these diseases.] AND DOES NOT RELIEVE
THE ATTENDING PHYSICIAN OF ANY REPORTING REQUIREMENT
UNDER §78 OF THIS ARTICLE.

[(d)] [[(E)]](F) The [Commissioner of Health or his
duly authorized agent, will] SECRETARY, HEALTH OFFICER,
AND THEIR RESPECTIVE AGENTS MAY not [under any
circumstances] contact the patient [or the potential
contacts of the patient] except by request or with the
consent [ (written when possible) ] of the attending
physician[ , when ] IF there is an attending physician AND
HE IS REASONABLY AVAILABLE. Nothing in this section,
however, precludes discussion of the laboratory
[notification] REPORT with the attending physician[,] by
the [Commissioner or his duly authorized agent]
SECRETARY, HEALTH OFFICER, OR THEIR RESPECTIVE AGENTS.

[(e)] [[(F)]](G) All laboratory [notifications
herein] REPORTS required UNDER THIS SECTION are
confidential and are not open to public inspection.

[[(G)]](H) TO DETERMINE COMPLIANCE WITH THIS
SECTION, THE SECRETARY, HEALTH OFFICER, OR THEIR
RESPECTIVE AGENTS MAY INSPECT PERTINENT RECORDS OF
LABORATORIES SUBJECT TO THE PROVISIONS OF THIS SECTION.
