hereby repealed and reenacted, with amendments, to read
as follows:
Article 43 - Health
257.
(A) [The Governor, upon the recommendations of the
Secretary of Health and Mental Hygiene, shall appoint
five persons to be Commissioners of Pharmacy, said
Commissioners to constitute and be known as the] THERE IS
A Maryland Board of Pharmacy, which [Board shall
constitute] IS part of the Department of Health and
Mental Hygiene. [Said]
(B) (1) THE BOARD CONSISTS OF SEVEN MEMBERS
KNOWN AS COMMISSIONERS OF PHARMACY.
(2) OF THE SEVEN Commissioners (I) SIX shall
be skilled and competent pharmacists, who hare had at
least five years' active pharmaceutical experience in
compounding and dispensing physicians' prescriptions, and
of whom at least [four] FIVE are actively engaged in the
practice of pharmacy[. ]; AND (II) ONE SHALL BE A
CONSUMER.
(3) None of [said] THE Commissioners shall
be connected with any school of pharmacy either as
teacher, instructor, or member of the board of trustees.
(4) Two [of said] Commissioners shall be
residents of the City of Baltimore, two SHALL BE
residents of the counties of the State, and [the fifth a
resident] THREE MAY BE RESIDENTS of either the City of
Baltimore or the counties of the State.
(C) The [persons serving as Commissioners on June
1, 1947, shall continue to serve as such until the
expiration of the term for which they have heretofore
been appointed and their successors are duly appointed
and qualified pursuant to the provisions of this section,
and the] Commissioners [thereafter appointed] shall serve
[as members of said] ON THE Board for [the] A term of
five years. [In the case of any vacancy or vacancies,
whether from expiration of term, resignation, death or
otherwise,]
(D) (1) EACH PROFESSIONAL MEMBER OF THE BOARD
SHALL BE APPOINTED BY the Governor, [upon the] ON
recommendation of the Secretary of Health and Mental
Hygiene, [shall appoint a successor] from a list of
pharmacists of three times the number of vacancies to be
filled, [said list to be] submitted by the Maryland
Pharmaceutical Association. [The said Commissioners
shall, after]
(2) EACH CONSUMER MEMBER OF THE BOARD SHALL
BE APPOINTED BY THE GOVERNOR, ON RECOMMENDATION OF THE
