The Said Defendt. having confessed Judgt. for ye Sume of five hundred pounds of Tobo. & Cost of Suite before he heard ye Decln. read Therefore It is Considered by ye Court here vizt. ye 25. Day of June Annoq Domi. 1701 That ye Said Plaintiffs Perigrine Browne & Compa. Doe recover from ye Said Defendt. Thomas Carman as well ye Sume of five hundred pounds of Tobo. Debt as alsoe ye Sume of Three hundred Thirty & five pounds of Tobo. Cost of Suite and ye Said Thomas Carman in Mercy Jno Dowdall Clk Comand was given to ye Sherf. of Kent County ye 29. day of Novemr. Annoq Domi. 1700 That he Take Thomas Carman likewise ye 13 Day of Febry Anno Domi. 1700 alius Dictus Thomas Carman of Kent County in ye Province Afsd. Planter if found in his bailiwick & him Safe Keepe Soe that he have his bodie before his Majties Justices at ye Next Courts to be held for Said County to Answer unto Mr. John Hyde Merchant James Smith Planter and Compa. of A plea that he render unto them ye full & just Sume of four hundred Eighty & nine pounds of good Sound Merchantable leafe Tobo. in Casque which &a. Which next Court vizt. & 28. Day of Janry Anno Domi. 1700 ye Day of ye returne of ye first writt being an Adjourned Court all prcepts were Contd. in ye Custody of ye Sherf. and other Officers untill ye Eleventh Day of Febry following On which Eleventh day of Febry ye Day of the returne of Said writt According to Adjournement. came ye Said Sherf. & made returne thereof Non East Inventus likewise came ye Said Sherf. on ye 25. Day of March anno Domi. 1701 ye Day of ye returne of Said Second writt & made returne thereof in these words vizt. Cepi corpus pr Elias King Sherf But ye Said Plaintiffs by Richard Macklin theire Attry Moves ye Court that ye Said Defendants Thomas Carman may be Comitted into ye Sherf. Custody & there to remaine untill he find Espll. baile to Said Action which was granted unto him Ordered Therefore That Elias King now Sherf. of Kent County doe take into his Custody ye bodie of ye Said Defendt. Thomas Carman & him Safe keepe untill he find Espll baile to this Action now depending between Mr Jon Hyde James Smith Planter & Compa. Plaintf. & ye Said Defendt. Thomas Carman Jno Dowdall Clk Who was Contd. untill ye Next Court And now here at this Day vizt. ye 25 Day of June Annoq Domi. 1701 Came ye Said Plaintf. by theire Said Attry & Decln. vizt.
