67 June Court 1701 full & just Sume of four hundred Eighty & nine pounds of good Sound Merchantable leafe Tobo. in Casque which to them he oweth & from them he unjustly Detaineth And whereupon ye Said Plaintf. by Richard Macklin theire Attry Saith that whereas ye Said Thomas Carman on ye first day of May Annoq Domi. 1700 at Chester River in Said County within ye jurisdiction of this Court by his Certaine bill or writing obligatory Sealed wth. his Seale as his act & deed delivered & here in Court brought whose date is ye Same day & yeare did bind himselfe his heires Exrs. & Adrs to pay or Cause to be paid unto ye Said John Hyde of London Merchant James Smith Planter & Compa. theire heires Exrs. Adrs. or Assignes or Lawfull Attry ye Said Sume of four hundred Eighty & nine pounds of Tobo. quallified as Afsd. Convenient in Chester River at or upon ye Tenth day of October next ensuing ye Date of ye Same bill yet Notwithstanding ye Said Thomas ye Said Sume of 489lb Tobo. according to the Tenr. of ye Same bill unto ye Said Plaintiffs he hath not paid altho offten Demanded but ye Same to pay hath denyed & refused & Still doth deny & refuse and unjustly detaine to ye Damage of ye Said Plaintf. Eight hundred Ninty & eight pounds of like Tobo. and thereupon they bring this Suite Macklin pr qr. But ye Said Thomas Carman Defendt. comes into Court together wth. Flower Walker his Security who oblidgeth himselfe that ye Said Defendt. Thomas Carman Shall pay Condemnacon if Cast or Else he will doe it for him After which ye Said Defendant comes into Court & Confesseth Judgement in his proper person for ye Said Sume of four hundred Eighty & nine pounds of Tobo. and Cost of Suite Therefore it is Considered by ye Court that ye Said Plaintf. John Hyde of London Merchant James Smith Planter & Compa. doe recover from ye Said Defendt. Thomas Carman as well ye Said Sume of four hundred Eighty & nine pounds of Tobo. debt as alsoe ye Sume of Three hundred forty & five pounds of Tobo. Cost of Suit & ye Said Thomas Carman in Mercy Jno Dowdall Clk Comand was given to ye Sherf. of Kent County ye Thirteenth day of Febry Annoq Domi. 1701 that he Take James Williames alius dictus James Williames of Said County if found in his bailiwick & him Safe keepe Soe that he have his bodie before his Majties Justices at ye Next Court to be held for Said County of A plea that he render unto him one young Mare between foure & five yeares of age Sound wind & limb &a. which &a. Att which next Court vizt. ye 25. Day of March Annoq Domi. 1701 ye Day of ye returne of Said writt came Elias King high Sherf. of Said County & made returne of Sd. writt in these words vizt. Cepi Corpus Elias King Sherf. And ye Said James Williames by Richard Macklin his Attry appeares & prayes thereof to Imparle untill ye next Court which was granted unto him ye Same day was given ye Plaintf. likewise M Earle pr qr. |
