Therefore it is Considered by ye Court here vizt. this 27 day of March Annoq Domi.
1701 That ye Said Plaintf. Henry Brayley doe recover from ye Said Defendt. as well ye
Sume of Thirteen pounds five Shillg. Sterg. Debt due upon balle. as alsoe ye Sume of
four hundred Thirty & four pounds of Tobo. cost of Suite & ye Said Thomas Tolley in Mercy

Comand was given to ye Sherf. of Kent County ye 29. day of Novemr. Annoq Domi. 1700
that he Take Thomas Tolley alius dictus Thomas Tolley of Kent County planter if found
in his bailiwick & him Safe keep Soe that he have his bodie before our Justices at ye next
Court to be held for our Said County ye fourth Tuesday of Janry next to Answer unto
Perigrine Browne and Compa. merchants of A plea of Debt      &a.
Which next Court vizt. ye 28 Day of Janry Annoq Domi. 1700 being an Adjourned Court
all prcepts were Continued in ye Corroner Constable & Sherf. Custody untill ye next
Court       Att which next Court vizt. ye Eleventh Day of Febry Annoq Domi.
1700 The day of ye returne of ye returne of Said writt According to Adjournemt. came
Elias King high Sherf. of Said County and made returne thereof in these words vizt.
                                                             Cepi Corpus       Elias King Sherf.
But ye Said Plaintfs by Richard Macklin theire Attry Moves ye Court that ye Said
Defendant Thomas Tolley might be Comitted into ye Sherf. Custody & thereto remaine untill he
find Espll. baile to Said Action which was granted unto him
Therefore ordered that ye Sherf. of Kent County doe Take into his Custody ye bodie of ye
Said Thomas Tolley into his Custody & there to remaine untill he find Espll. baile to Said
Action who was Comitted Accordingly                                     Jno Dowdall Clk
And now here at this Day vizt. ye 27 Day of March Annoq Domi. 1701 Came ye Said
Plaintf. by his Said Attry & Decln. vizt.
Maryland Kent County Ss    Thomas Tolley otherwise called Thomas Tolley of Kent County

   planter was Sumoned to Answer unto Perigrine Browne &

   Company Merchants of A plea that he render them ye Sume

   of Three Thousand four hundred thirty & three pounds of good

   Sound Merchantable Tobo. in Casque clear of ground leaves &

   other Trash which them he oweth & from them he unjustly

   detaineth
And Whereupon ye Said Plaintf. by Richard Macklin theire Attry Sayes that whereas ye Said
Thomas ye 24 day of June Ano. Domi. 1700 at Kent County within ye jurisdiction of this Court
by his certaine bill or writeing Obligatory Sealed wth. his Seale as his Act & deed delivered & here in
Court brought whose date is ye Day & Yeare Afsd did bind himselfe his heires Exrs. or Adrs. to
pay or cause to be paid unto ye Said Will Frisby or to his Exrs for ye Afsd. plaintf. theire
heires Exrs. Adrs. or Assignes on demand ye ye Said Sume of Three thousand three hundred forty
three pounds of Tobo. quallified as Afsd. at ye then dwelling plantacon of the Said Thomas in
Kent County Yet Notwithstanding ye Said Thomas ye Said Sume of 3343lb Tobo altho often demanded
according to ye Tenr. of ye Same bill hath not paid but ye Same to pay hath & as yet doth deny &
Refuse to ye damage of ye Said Plaintfs. 6000lb. Tobo. & thereupon they bring this Suite
                                                                                                Macklin pr qr.
On which day ye Said Defendt. Thomas Tolley comes into Court Together with James Wrath his
Security and ye Said James oblidges himselfe that ye Said Thomas Tolley Shall pay Condemnacon
if Cast or Else he will pay it for him
