      But ye Said Thomas Tolley Defendant comes into Court & Confesseth Judgement for
ye Said Debt & Cost of Suite

Therefore it is Considered by ye Court here vizt. ye 27 Day of March annoq Domi
1701 That ye Said Peregrine Browne and Compa. of London Merchants Plaintiffs doe recover
from ye Said Defendt. Thomas Tolley as well ye Sume of Three Thousand foure hundred
Thirty & Three pounds of Tobo. Debt as alsoe ye Sume of Two hundred Seaventy & one pounds
of Tobo. cost of Suite and ye Said Thomas Tolley in Mercy                 John Dowdall Clk

Comand was given to ye Sherf. of Kent County ye Thirteenth day of Febry Annoq
Domi. 1700. That he Take Thomas Hawkins of Kent County Planter if found in yr
bailiwick & him Safe keepe Soe that you have his bodie before our Justices at ye next
Court to be held for our Said County to Answer unto John Hawkins of A plea of Trespass
upon ye Case &a.
   And now here at this Day vizt. ye 25. Day of March Annoq Domi. ye day of ye returne
of Said Writt came Elias King high Sherf. of Said County & Made returne thereof thus
Endorsed vizt.                                Cepi corpus pr Elias King Sherf.
   But a Copie of ye Decln being Sent along wth. ye writt & Delivered in time According
to Act of Assembly &a.    ye Plaintf. Decln. vizt.
Kent Ss    Thomas Hawkins of Kent County planter Stands Attached to Answer unto John

   Hawkins of A plea of Trespass upon ye Case
And whereupon ye Said John by Richard Macklin his Attry complaines & Sayes ye whereas ye
Said John ye fifth day of May Anno Domi. 1699 at Chester River in Said County within ye
jurisdiction of this Court at ye espll. instance & request of ye Said Thomas Sold & delivered to ye Sd.
Thomas to ye proper use of ye Said Thomas divers goods & Merchandizes Amounting to ye Sume
of five hundred Twenty Six pounds of Tobo. and by an Acct. thereof to this decln. annexed & here
:into Court brought ye Same Appeares in consideracon thereof ye Said Thomas upon himselfe
Assumed & unto ye Said John then & there faithfully promised that he ye Said Thomas when
thereunto Afterwards required ye Said Sume of five hundred Twenty & Six pounds of Tobo. well &
truly he would pay & content Yet Notwithstanding ye Said Thomas his promise & Assumption Afsd.
in manner & forme Afsd. made little regarding but Shifting & intending ye Said John of ye Afd.
five hundred Twenty Six pounds of Tobo. craftily & Subtily to decieve & defraud ye Said 526lb
Tobo. altho often demanded did not pay but ye Same to him to pay altogether denyed & yet
doth deny to ye damage of ye Said John Hawkins 1000lb Tobo & thereupon he brings this Suit
