   Which cause was Contd., & ye Said Defendt. in ye Sherf. Custody untill this prsent Court
vizt ye 27 day of March Annoq Domi. 1701 ye Plaintf. Declaration vizt.
Maryland Ss    Thomas Tolley of Kent County Gentn. Stands Attached to Answer unto Henry Brailey
Kent County    of A plea of Trespass upon ye Case
     And whereupon ye Said plaintf. by Richard Macklin his Attorney Complaines that whereas ye
Said Plaintf ye twenty fifth day of Septemr. Anno Domi. 1699 at ye Spll. instance & request of ye
Said Defendt. but for ye proper use & behoofe of ye Said Plaintf. on ye day & yeare Afsd. did
Ship on board ye good Ship Called ye factor Sundry goods wares & merchandizes Amounting to ye
Sume of Nineteen pounds five Shillings Sterg. which Said goods &a. ye Said Plaintf. did
consigne & Send in ye Afsd: Ship Factor for Maryland to be Delivered by ye Master of ye Said
Ship Factor to ye Said Defendt. to be disposed of by ye Said Defendant for ye Said Plaintf. use
& behoofe and ye Said Plaintf. in fact further Saith that ye Said Ship Factor did Safely
arrive in Maryland and ye Said goods &a. Soe as Afsd. consigned and Sent by ye Said Plaintf. to
ye Said Defendant in ye Said Ship Factor was Safely & in good order delivered to ye Said Defendt.
which Said goods &a. amounting to ye Afsd. 19lb.05s.00d Appeares by A particular Acct. thereof to this
Decln. annexed and here into Court brought in Consideracon whereof ye Said Defendt. at Kent
County within ye jurisdiction of this Court upon himselfe did Assume and unto ye Said plaintf.
faithfully promised that he ye Said Defendt. when thereunto Afterwards required a true & just
account of ye Afsd. goods wares & merchandizes unto ye Said Plaintf. he would fairely render
together wth. ye Sales of ye Said goods Yet Nevertheless ye Said Defendt. his Afsd. promise & Assump
:tion little regarding or minding but plotting contriving & fraudulently intending ye Said plaintf. of ye
Afsd. goods wares & mercandizes craftily & Subtily to decieve & defraud ye Said goods &a. Sales or
profitts thereof to ye Said plaintf. ye Said Defendant hath not made rendered or given altho
often demanded but ye Same goods to his owne use and advantage hath imployed & disposed
whereupon ye Said plaintf. Saith he is damnified and damage hath to ye value of Thirty Eight
pounds Sterg. and thereupon he brings this Suite       Macklin pr qr.
