Annoq Domi 1699 ye Said Edward did prosecute and obtaine out of the Court of our
Lord ye King held for ye Said County A Certaine writt Directed to ye Afsd Elias King Sherf.
of ye Same County Comanding him ye Said Elias to Take ye bodie of ye Said Thomas Burrows
if found in his bailiwick & him Safe keepe Soe that he have his bodie before his Majties
Justices Att ye Next Court to be held for Said County ye fourth Tuesday of Janry next
ensuing ye date of ye Same writt which Said writt Afterwards that is to Say on ye 20th. day of
Janry Annoq Domi 1699 was delivered unto him ye Said Elias then Sherf. of ye Said County
in forme of right to be Executed; by vertue of which writt the Said Sherf. Afterwards that is
to Say on ye 22d. day of Janry Ano. Domi. 1699 did Take ye Said Thomas Burrows and him ye Sd.
Thomas had in his Custody by virtue of ye Afsd. writt as by ye returne of ye Same writt
here in Court produced Appeares. yet nevertheless ye Said Elias being Sherf. as Afsd. and
not regarding ye duty of his Said Office nor his oath Taken for ye due Execution of ye Same
but craftily & Subtilly contriving and intending to decieve and defraud ye Said Edward of ye
Afsd. eighteen hundred forty & Two pounds of Tobo. on ye 5. Day of Febry Annoq Domi. 1699
at Kent County Afsd. within ye jurisdiction of this Court him ye Said Thomas Burrows at
large whither he would to goe & Escape he ye Said Elias did permitt & Suffer without ye
Lycence and consent and against ye will of him ye Said Edward ye Said Eighteen hundred
forty & Two pounds of Tobo not being paid & Satisfied; and ye Said Thomas ever Since hither:
to to places to ye Said Edwd. Unknowne did and yet doth absent and eloyne himselfe Soe that
[y]e Said Edwd. could not by any process of Law Since get him ye Said Thomas taken and thereby
[ye] Said Edwd. ye benefitt and advantage of ye recovery of ye Said Eighteen hundred forty &
Two pounds of Tobo. whereupon ye Said Edward Saith that he ye worse is & damage hath
recieved to ye value of Three Thousand Six hundred Eighty & four pounds of Tobo. and
[th]ereupon he brings this Suite       M Earle pr qr.
