45                           March    Court    1701
   Comand was given to ye Sherf. of Kent County ye 29. day of Novemr. Annoq Domi. 1700 that
he Take Henry Hynson alius dictus Henry Hynson of Kent County Planter if found in yr. bailiwick
and him Safe keepe Soe that he have his body before our Justices at ye next Court to Answer
unto Perigrine Browne & Compa. of London Merchants of A plea of Debt

Which next Court vizt. ye 28 day of Janry Annoq Domi. 1700 being an Adjourned Court
all prcepts were contd. in ye Sherf. Custody untill ye next Court

Att which next Court vizt. ye Eleventh Day of Febry Anno Domi. 1700 ye Day of ye
returne of Said Writt According to Adjournemt. came Elias King high Sherf. of Sd. County
& made returne thereof in these words vizt.         Cepi Corpus    pr    Elias King Sherf.

On which Said Day ye Said Plaintf. by Richard Macklin theire Attorney moves ye Court that
ye Said Defendt. Henry Hynson may find Espll. baile to Said Action & that he may be Comitted unto
ye Sherf. Custody untill he find Espll. baile which was granted unto him

Ordered Therefore that ye Said Defendt. Henry Hynson doe find Spll. baile to Said action
and that ye Sherf. of this County of Kent doe take him into his Custody & there to remaine
untill he find Espll. baile which was Done Accordingly            Jno Dowdall Clk

But ye Said Defendt. Henry Hynson comes into Court together wth. Robert Smith his
Security who promiseth that ye Said Defendt. Henry Hynson Shall pay Condemnacon if Cast or
else he will doe it for him

On which Said day ye Said Defendt. Henry Hynson in his proper person Appeares and prayes
thereof to Imparle untill ye next Court which was granted unto him ye Same Day was given to
Plaintf. also                                                              Macklin pr qr.

And now here at this Day vizt. ye 27. Day of March Annoq Domi. 1701 Came ye Said Plaintf.
by Richard Macklin theire Attry and ye Said Cause Standing for Tryall ye Plaintf. Decln

Maryland    Ss     Henry Hynson otherwise Called Henry Hynson of Kent County Planter was
Kent County    Sumoned to Answer unto Perigrine Browne of London merchant of A plea that

   he render him ye full and just Sume of one Thousand Nine hundred thrity & five

   pounds of Every way well condiconed bleafe Tobo. in Casque which to him he oweth

   and from him he unjustly Detaines
And Whereupon ye Said Plaintf. by Richard Macklin his Attry complaines and Sayes that
whereas ye Said Henry ye 27. Day of Febry Anno Domi. 1699 at Chester River within ye
jurisdiction of this Court by his certaine bill or writing Sealed with his Seale as his Act &
deed delivered and here in Court brought whose date is ye Same day & yeare Afsd. did bind
himselfe his heires Exrs. and Adr. to pay or Cause to be paid unto ye Said Plaintf. or to his
heires Exr. Adr. or Assignes ye Said Sume of 1935lb. Tobo. quallified as Afsd. convenient in ye
Said County at or upon ye Tenth Day of October next ensuing ye Date of ye Same bill Yet
Notwithstanding ye Said Henry ye Said 1935lb. Tobo. According to ye Tenr. of ye Same bill unto ye
Said Plaintf. did not pay but ye Same to pay hath and Still doth deny & refuse to ye Damage
of ye Said Plaintf. 3000lb Tobo. and thereupon he brings this Suite       Macklin pr qr.

But ye Said Plaintf. by his Said Attry prayes that ye Said Defendt. might come into Court
and Answer to his Said Decln. who neither by himselfe nor Attry Appearing Judgt. is given
against him by Default

Therefore it is Considered by ye Court here that ye Said Plaintf. Peregrine Browne doe
recover from ye Said Defendt. Henry Hynson as well ye Sume of one thousand nine hundred
thirty & five pounds of Tobo Debt as alsoe ye Sume Three hundred Twenty and one pounds of Tobo
cost of Suite and ye Said Henry Hynson in mercy                                          Jno Dowdall Clk
