Certaine bill or writing obligatory Sealed wth. his Seale as his Act & deed delivered and
here in Court brought whose date is ye Day & yeare Afsd. did bind himselfe his heires
Exr. and Adr. to pay or cause to be paid unto ye Said Edwd. Fry ye Said Sume of one Thousand
one hundred thirty and eight pounds of tobo. quallified as Afsd. Convenient in Said County
at or upon ye tenth day of octor. next ensuing ye date of ye Same bill yet notwithstanding ye Sd.
Danll. ye Said Sume of one thousand one hundred thirty and Eight pounds of Tobo. according
to ye tenr. of ye Same bill hath not paid but ye Same to him to pay hath and Still doth deny
and refuse to ye damage of ye Said Edwd. Fry Two thousand Two hundred Seaventy & Six pounds
and thereupon he brings this Suite                 Macklin pr qr.
But ye Said Plaintf. by his Said Attry prayes that ye Said Defendt. Danll. Toaes might
come into Court and make answer to his Said Decln who neither in his proper
person nor by by his Attry appearing Judgemt. is awarded to ye Said Plaintf for
ye Said Sume of one Thousand one hundred thirty and Eight pounds of Tobo. and Cost
of Suite

Therefore it is Considered by ye Court that ye Said Plaintf. Edwd. Fry doe recover
from ye Said Defendant Danll. Toaes as well ye Sume of one thousand one hundred
thirty and Eight pounds of Tobo. Debt as alsoe ye Sume of Three hundred and one
pounds of Tobo. cost of Suite and ye Said Danll. Toaes in Mercy       Jno Dowdall Clk

Comand was given to ye Sherf. of Kent County ye 28. Day of Janry Anno Domi. 1700
that he Take William North alius Dictus Wm North of Kent County Planter if found
in his bailiwick & him Safe keepe Soe that he have his body before his majties Justices
at ye next Court to be held for Said County to Answer unto Edwd. Fry of A plea yt
he render him ye full Sume of Seaven hundred pounds of good Sound merchantable
leafe Tobo. and Casque which to him he oweth & from him he unjustly Detaineth

And whereupon ye Said Edwd. by Richard Macklin his Attry Sayes that whereas ye Sd. Wm
at Chester River within ye jurisdiction of this Court ye 27 day of Augt. 1700 by his
certaine bill obry Sealed wth. his Seale as his Act & deed delivered & here in Court brought
whose date is ye day & yeare Afd did bind himselfe his heires Exrs. Adrs. to pay or
cause to be paid unto ye Said Edwd. Fry his heires Exrs. Adrs. or Assignes ye Said Sume
of four hundred pounds of Tobo. quallified as Afsd. Yet notwithstanding ye Said Wm ye Sd.
Sume of Seaven hundred pounds of Tobo. according to ye tenr. of ye Same bill unto ye Sd Edwd.
hath not paid but ye Same to him to pay hath denyed & Still doth deny & refuse to ye dam
:age of ye Said Edwd. one thousand four hundred pounds of Tobo. and thereupon he
brings this Suite       Macklin pr qr.    pledges &a.                      Jno Doe Rd. Roe
The Sd. William having Appeared to ye Action last Court and Imparled unto ye Court
ye Said Plaintf. Edwd. Fry by his Said Attry prayes that ye Said Defendt. Wm North
to his Decln. Afsd. might Answer who neither by his Attry nor in his proper person
Appearing Judgt. is given agt. him by Default

Therefore it is Considered by ye Court here vizt. ye 27. day of March Anno Domi. 1701 that
ye Said Plaintf. Edward Fry doe recover from ye Said Defendt. William North as well ye
Sume of Seaven hundred pounds of Tobo. Debt as alsoe ye Sume of Two hundred and Eighty
pounds of Tobo. Cost of Suite and ye Said William North in Mercy         Jno Dowdall Clk
