44                      March    Court    1701
Pounds of Tobo. unto ye Said Edward altho often demanded he hath not paid but ye
Same to pay hath and Still Doth deny & refuse to ye Damage of ye Said Edwd. eight
hundred pounds of Tobo. and thereupon he brings this Suite       Macklin pr qr.

But ye Said Plaintf. by his Said Attry prayes that ye Said Defendant Danll. Toes
might come into Court and make Answer to his Said Decln. who neither in his proper
person nor by his Attry Appearing Judgemt. is awarded to ye Said Plaintf. for ye
Said Sume of four hundred pounds of Tobo & cost of Suite

Therefore it is Considered by ye Court here that ye Said Plaintf. Edwd. Fry doe recover
from ye Said Defendant Danll. Toaes as well ye Sume of foure hundred pounds of
Tobo. Debt as alsoe ye Sume of Two hundred Seaventy & Three pounds of Tobo. cost of Suite
and ye Said Danll. Toaes in Mercy                                          Jno Dowdall Clk

Comand was given to ye Sherf. of Kent County ye 24 day of Sepr. Anno Domi. 1700 that
he take Danll. Toaes alius Dictus Danll. Toaes of Kent County Gentn. if found in his
bailiwick and him Safe keepe Soe that he have his bodie before our Justices at ye next
Court to be held for our Said County to Answer unto Edwd. Fry of A plea of Debt
Att which next Court vizt ye 26. day of Novemr. Annoq Domi. 1700 ye day of ye
day of ye returne of Sd. writt came Elias King high Sherf. of Said County and made
returne thereof in these words vizt.    Non East Inventus       pr Elias King Sherf.

Comand was likewise given to ye Said Sherf. of Kent County ye 29. day of Novemr. Annoq
Domi. 1700 that he Take Danll. Toaes alius dictus Danll. Toaes of Said County Gentn. if
found in his bailiwick and him Safe keepe Soe that he have his bodie before our Justices
at ye next Court to be held for Said County to Answer unto Edwd. Fry of A plea of
Debt               Att which next Court being an Adjourned Court all causes were contd

   and all prcepts were contd. in ye Sherf. Custody untill ye Next Court

Att which next Court vizt ye Eleventh day of February ye Day of ye returne of
Said Writt According to Adjournemt. came Elias King high Sherf. of Said County and
made returne thereof in these words vizt.    Cepi corpus pr      Elias King Sherf.
On which Said day ye Said Defendt. Danll. Toes Appeares in his proper person
and prayes thereof to imparle untill ye next Court which was granted unto him ye Same
day was given ye Plaintf alsoe Macklin pr qr.
And now here at this day vizt. ye 27. day of March 1701 came ye Said Plaintf. by Rd.
Macklin his Attry and ye Said Cause Standing for Tryall ye Plaintf. Decln
Maryland       Ss    Danll. Toaes alius Dictus Danll. Toaes of Kent County Gentn. was Sumoned
Kent County    to Answer unto Edwd. Fry of A plea that he render him ye full Sume of one

   Thousand one hundred thirty & eight pounds of good Sound Merchantable leafe

   leafe Tobo. and Casque which to him he oweth & from him he unjustly detaines
And whereupon ye Said Edward Fry by Richard Macklin his Attry Sayes that whereas ye Sd. Danll
at Kent County within ye Jurisdiction of this Court ye first day of May Anno Domi. 1700 by his
