   Comand was given to ye Sherf. of Kent County ye 24 day of Sepr. Anno Domi. 1700
that he take Danll. Toaes of Said County Gentn. if found in his bailiwick & him Safe keep
Soe that he have his bodie before his majties Justices at ye next court to be held for
Said County to Answer unto Edwd. Fry of Said County Inholder of A plea of Trespass upon
ye case

Att which next Court vizt. ye 26. day of Novemr. ye day of ye returne of Said writt came
Elias King high Sherf. of Said County & made returne thereof in these words vizt.
                                                                       Non East inventus    Elias King Sherf

Comand was likewise given to ye Said Sherf. of Kent County ye 29. Day of Novemr. Anno
Domi. 1700 That he take Danll. Toaes of Said County Gentn. if found in his bailiwick &
him Safe keepe Soe that you have his bodie before our Justices at ye next Court to
answer unto Edward Fry of Said County Inholder of A plea of Trespass upon ye case

Att which next Court vizt. ye 28th. day of Janry being an Adjourned Court all causes
were continued untill ye next Court and all precepts were contd. in ye Sherf. Custody until
ye Said Court       Att which next Court vizt. ye Eleventh day of February Anno
Domi. 1700 ye Day of ye returne of Said writt according to Adjournemt. came Elias
King high Sherf. of Said County and made returne thereof in these words vizt.
                                                                       Cepi corpus pr    Elias King Sherf.
On which Said day ye Said Defendt. Danll. Toaes in his proper person Appeares and
prayes thereof to imparle untill next Court which was granted unto him ye Same day
was given to ye Plaintf. alsoe       Macklin pr qr.

And now here at this day vizt. ye 27 day of March 1701 came ye Said Plaintf by his
Said Attry and ye Said Cause Standing for Tryall ye Plaintf. Decln vizt.
Kent Ss    Danll. Toaes of Said County Stands Attachted to Answer unto Edwd. Fry of A plea of

   Trespass upon ye case
And whereupon ye Said Edward by Richard Macklin his Attry complaines that whereas
A certaine William Dixon being indebted unto ye Said Edward in ye Sume of four hundred
pounds of Tobo. and ye Said William being as Afsd. indebted on ye Seaventh day of octor. Anno
Domi> 1700 did draw his certaine order directed to ye Said Danll. Toaes thereby requesting
ye Said Danll. to pay unto ye Said Edward Fry or his order ye Said Sume of four hund:
[:]red pounds ot Tobo which Said order ye Said Danll. did accept and with his proper hand
Subscribed thereby promising payment of ye Said four hundred pounds of Tobo. in ye
Said ordr. menconed which Said order together wth. ye Said Danlls Acceptance is hereinto
Court brought and ye Said Edward in fact Saith that trusting to ye Said Danlls. acceptance
of ye Said order and ye Said Danlls. faire promise of payment thereof he did acquitt and
discharge ye Said William of & from ye Said Sume of four hundred pounds of Tobo. & did
accept & take ye Said Danll. for payment thereof In consideracon therof ye Said Danll.
upon himselfe Assumed and unto ye Said Edward faithfully promised that he ye Said
Danll. when thereunto afterwards required ye Said Sume of four hundred pounds of Tobo.
unto ye Said Edward he would well and Truly pay Yet nevertheless ye Said Danll. his Afsd
promise and Assumption not regarding but plotting and fraudulently intending ye Sd. Edwd.
in this behalfe craftily & Subtilly to decieve & defraud ye Said Sume of four hundred
