Just Sume of five hundred pounds of good Sound Merchantable Tobo. and Casque &a. wch. &a.
Att which next Court vizt. ye 29 Day of Augt. Annoq Domi. 1700 ye Day of ye returne
of Said writt came Elias King high Sherf. of Said County & made returne thereof in these
words following              Cepi Languidas    pr                                Elias King Sherf.
The which case being contd. from Court untill prsent Court And now here at this day vizt.
ye 27. day of March Annoq Domi. 1701 ye Said Plaintf. by Michael Earle his Attry prayes
Judgt. for his Said Debt & cost to be Granted unto him But ye Said Defendt. Thomas
Usher neither by himselfe nor his Attry Appearing Judgemt. is Awarded agt. him

Therefore it is Considered by ye Court here that ye Said Plaintf. James Rae doe recover
from ye Said Defendt. Thomas Usher as well ye Sume of five hundred pounds of Tobo Debt
as alsoe ye Sume of Two hundred Sixty & Six pounds of Tobo Cost of Suite and ye Thomas
Usher in Mery                                                                   Jno Dowdall Clk

Comand was given to ye Sherf. of Kent County ye 29. Day of Augt. Annoq Domi. 1700
that he Take Tabitha Norreast Charles Wright & Ketherine his wife Exrs of ye Last
will & Testament of Robert Noreast late of Said County Carpenter Decd. if found in his
bailiwick & them Safe keepe Soe that you have theire bodies before our Justices at a
Court to be held for our Said County ye fourth Tuesday of Sepr. next to Answer James
Rae of Ceecill County merchant of A plea of Trespass upon ye Case
Which next Court being an Adjourned Court all prcepts were continued in ye Sherf.
custody untill ye next Court Att which next court vizt. ye 26. day of November
ye day of ye returne of Said writt according to Adjournemt. came Elias King high Sherf.
of Said County & made returne thereof in these words vizt. cepi copus pr me

On which Said day came ye Said Defendants by Richard Macklin theire Attry
and prayes thereof to imparle untill ye next court which was granted unto them ye
Same day was given ye plaintf. likewise      M Earle pr qr.
which cause being contd. from Court to court untill this prsent Court vizt. ye 27. day
of March Anno Domi. 1701 now comes as well ye Said ye Said Defendts. by theire
Said Attry as alsoe ye Said Plaintf. by Michael Earle his Attry & ye Said Cause
Standing for Tryall ye Plaintf. Decln. vizt.
Kent County       Ss    Tobitha Norreast Charles Wright & Catherine his wife Exrs. of ye last
in Maryland    will & Testamt. of Robert Noreast late of Said County Carpenter

   Decd. Stands Attached to Answer unto James Rae of ye Citty of

   London merchant of A plea of Trespass upon ye case
   And whereupon ye Said James by Michael Earle his Attry complaineth that whereas
ye Said Robert in his lifetime to witt ye 27. day of March Annoq Domi. 1699 in Ceecill
County within ye jurisdiction of this Court at ye Spll. instance & request of ye Said Robert
in his lifetime had Sold & delivered unto him ye Said Robert by ye Said James divers
goods wares & merchandizes and alsoe at ye like instance & request in ye yeare Afsd. &
within ye jurisdiction Afsd. ye Said James paid unto a certaine Morris Shaw for ye Said
Robert ye Sume of Twelve pence Sterg. all which by A particular Acct. hereunto anexed
and here in Court brought ye Same Appeares amounting in ye whole to ye Sume of
