March Court 1701 40 To ye Said Richard Watts Severall goods wares and merchandizes as by an Acct. of ye particulars thereof to this Decln. annexed and here in Court brought ye Same appeares in consideracon whereof ye Said Richard Watts upon himselfe Assumed and to ye Said Nathll. faithfully promised that he ye Said Richard Watts would pay to him ye Said Nathanll. when thereunto he Should be Afterwards required Soe much Tobo. as he ye Said Nathanll. Should therefore reasonably deserve and ye Said Nathanll. in fact Saith that for ye Said goods wares & merchandizes in ye Said bill of particulars to this Decln. Annexed as Afsd. he doth reasonably deserve to have ye Sume of four hundred Ninty & five pounds of Tobo. Yet ye Afsd. Richard Watts his promise and Assumption Afsd. little regarding but plotting contriving & fraudulently intending ye Afsd. Nathanll. in that behalfe craftily & Subtilly to decieve & Defraud ye Afsd. Severall Sumes of Tobo. in ye Afssd. Acct. or bill of particulars contained amounting to ye Afssd. Sume of 495lb. of Tobo. to him ye Said Nathanll. altho at Wye River in Talbott County within ye jurisdicton of this Court on ye 20th. day of Janry Anno Domi. 1697 & often Afterwards he hath been thereunto required According to his promise & Assumption AffSaid he hath not paid but ye Same hitherto to pay he hath altogether refused and Still doth refuse to ye Damage of ye Said Nathanll. Hynson Eight hundred pounds of Tobo and thereupon he brings this Suite Macklin pr qr. pledges &a. Jno Doe Rd. Roe
Two of his Majties Justices for Said County ye above Nathanll. Hynson and made oath that ye above Acct. is a True Acct. and noe part thereof recd. Wm Frisby Jno Hynson And ye Said Plaintf. by Richard Macklin his Attry prayes that ye Said Defendant Richd. Watts would come & Answer to his Said Decln. but ye Said Defendt. neither by an Attry nor in his proper person Appearing to defend the Said Action Said Plaintf. by his Attorney Afsd. prayes Judgemt. pr Default which was granted unto him Therefore it is considered by ye Court here that ye Plaintf. Nathanll. Hynson doe recover from ye Said Defendt. Richard Watts as well ye Sume of foure hundred ninty & five pounds of Tobo Debt as alsoe ye Sume of foure hundred and nine pounds of Tobo Cost of Suite and ye Said Richard Watts in mercy Jno Dowdall Clk Comand was given to ye Sherf. of Kent County ye 26. Day of June Annoq Domi. 1700 That he Take Thomas Usher alius Dictus Thomas Usher of Kent County Miller if found in your bailiwick & him Safe Keepe Soe that you have his body before our Justices at A Court to be held for Said County ye fourth Tuesday of August Next to Answer unto James Rae of Ceecil County Merchant of A plea that he render unto him ye full & just |
