of five hundred Seaventy one pounds of Tobo. in consideracon whereof ye Said
Robert in his life time upon himselfe Assumed and unto ye Said James faithfully
promised that he ye Said Robert ye Said Sume of 571lb of Tobo unto ye Said James
he would well & truly pay when thereunto Afterwards required Yet nevertheless ye Sd.
Robert in his life time ye Said 571lb of Tobo. according to his promise & Assumption
unto ye Said James he did not pay altho often demanded neither hath ye Said Exrs. nor
either of them Since ye death of ye Said Robert paid in theire capacities paid ye Said
571lb. of Tobo. altho often thereunto required but ye Same to pay they have denyed and
refused & Still doth deny and refuse and Unjustly detaine to ye damage of ye Said James
one Thousand pounds of Tobo. & thereupon he brings this Suite                      Jno Doe

Norrests Exr.       And ye Said Defendt. by Richard Macklin his Attry comes and
ads       defends ye force and injury when &a. and demurs in Law to ye
James Rae       Plaintf. Decln. &a.


Reason    The Plaintf. Declares in his Declaracon that ye plaintf. Sold goods & paid

   to a certaine Morris Shall Twelve pence which amounts to 571lb. Tobo. but

   doth not Set forth how much ye goods Sold amounts unto or what Sume of

   Tobo. is charged for ye 12d. in money ye Said Acct. being Sie promiscuously

   charged that ye Said Defendants cannott answer       Macklin pr Defendts
                                                   Demurr Joyned Earle pr qr.

The which demurrer being argued and by ye Court heard & considered was overruled
and judgemt. given to ye Said Plaintf. at ye Said Defendants for ye Said Sume of
of five hundred Seaventy and one pounds of Tobo. & Cost of Suite

Therefore it is Considered by ye Court here that ye Said Plaintf James Rae doe
recover from ye Said Defendants Tobitha Norreast Charles Wright & Catherine
his wife Exrs. of Robert Norrest Decd. in theire Capacities as well ye Sume of
five hundred Seaventy and one pounds of Tobo. Debt as alsoe ye Sume of Two hund
:red Seaventy and nine pounds of Tobo. cost of Suite and ye Said Defendants in mercy
