March Court 1701 37 Comand was Therefore given to ye Sherf. County that he cause to come here Twelve &a. by whom &a. who neither &a. to recognize &a. to which ye Said Sherf. made Answer he had there ready Twelve &a. as by his prcept he was comanded vizt. Richard Mason foreman Mathew Mason Thomas Carman Thomas Cooke Nathanll. Cleave Richard Fillingham Thomas Browne William Robinson John Ponder Benjn Bond Charles Floyd and Henry Green which Jury being duly Tryed and Sworne To try ye Issue as Above Joyned & having heard ye Evidences pleading and alegacons on both Sides ye Court giveth them theire Charge who withdraw to consider on ye prmisses & after Some time doe againe returne and being againe Called over as alsoe ye Plaintf. and Defendt. and being Demanded who they find for doe Say wee ye jury doe find for ye Defendt. and by Richd. Mason theire Therefore it is considered by ye Court here That ye Said Defendt. John Dubroise as to ye Said Action goe thereof without day And it is likewise considered that ye Said Defet. doe recover from ye Said Plaintf. Richard Jorum as well ye Sume of fifty pounds of Tobo. for A Nonsuite According to Act of Assembly in that Case made & provided as alsoe ye Sume of Seaven hundred Ninty and one pounds of Tobo. cost of Suite and ye Said Richard Jorum in Mercy Jno Dowdall Clk Richd. Macklin having moved ye Court that Thomas Tolley might Enter into Recognize. wth. Suffitient Security for his good behaviour in ye meane time & Appearance at ye next Court which was Granted It was thereupon Ordered that ye Sherf. of this County doe Take into his Custody ye Said Thomas Tolley & there to remaine untill he find Suffitient Security for his Appearance at ye next Court to be held for this County and his good abearance in ye meane time Jno Dowdall Clk The Said Thomas Tolley comes into Court and brings Thomas Cooke & Richard Mason his Securities Along wth. him And ye Said Thomas Tolley doth acknowledge himselfe to owe and Stand justly indebted unto our Soveraigne Lord King Wm ye Third his heires and Successors in ye full and just Sume of Tenn pounds Sterg. To be leavied upon his Lands & Tenements goods and Chattles if ye Said Thomas Tolley doe not make his personall Appearance here at ye next Court and be of good behaviour and Abearance to all his Majti[es] Leidge Subjects in ye mean time and ye Said Thomas Cooke & Richard Mason his Securi :ties doe Acknowledge themselves to owe & Stand justly indebted unto our Soveraigne Lord ye King his heires and Successrs in full & just Sume of five pounds Sterg. Each to be leavied as Afsd. Condiconed as Afsd. wherewith they are Content Mr. Phillip Hopkins takes his place upon ye bench Ordered That George Green & Robert Ingram have a Warrant as overseers to get & most convenient way Cleared from ye head of Morgans Creeke halfe way to Thomas Windalls in Ceecill County Capt.
