Therefore it is Considered by ye Court here that ye Said Defendt. as to ye Said Action goe thereof without day And it is likewise considered that ye Said Defendant doe recover from ye Said plaintf. as well ye Sume of fifty pounds of Tobo. for A Nonsuite as Alsoe ye Sume of one Thousand five hundred pounds of Tobo. Cost of Suite and ye Said Isaac Davis in mery Jno Dowdall Clk Comand was given to ye Corroner of Kent County ye 29. Day of Augt. Annoq Domi. 1700 That he Take Elias King of Kent County Gentn. Exr. of Edwd. Sweatnam late of Kent County Decd. who was Exr. of Richd. Sweatnam late of Talbott County Decd. if found in his bailiwick & him Safe keepe Soe that you have his body before our Justices at a Court to be held for our Said County ye fourth of Septemr. next to answer unto Edwd. Baracliff late of Talbott County milwright in A plea that he render to him Twenty Three Thousand Three hundred Twenty & one pounds of Tobo. which from him he unjustly Detaines Which next Court being Andjourned Court all Causes were Contd. and all writts & other precepts were Contd. in ye Sherf Custody & Corroners untill ye 26. day of Novemr. following Att which next Court vizt. ye 26. day of Novemr. Anno Domi. 1700 ye Day of ye returne of Sd. writt Come Thomas Smith Corroner of Said County & made returne thereof vizt. Cepi Corpus Thos. Smith Corr. On which Sd. Day ye Said Defendt. in his Capacity by Richd. Macklin his Attry Appeares & pray[es] thereof to Imparle untill ye next Court which was Granted unto him ye Same day was given ye Plaintf. likewise Earle pr qr. Which Cause being Continued from Court to Court untill this prsent vizt. Febry ye 13. 1700 & ye Sd. Cause now Standing for Tryall ye Plaintf. Decln. vizt.
Richard, to witt, ye Thirtieth day of July 1691 was Indebted unto ye Said Edwd. by his certain bill in writing Sealed wth. his Seale as his Act & deed Delivered & here in Court brought whose date is ye day & yeare Afsd. did bind himselfe his heires Exrs. Adrs. to pay or Cause to be paid unto ye Sd. Edwd. Baracliff his heires Exrs. Adrs. ye full & just Sume of Twenty Three Thousand Three hundred Seaventy one pounds of good Sound merchantable Tobo.in Casque Convenient in ye County Afsd. at or upon ye Tenth day of Novemr. next ensuing ye Date thereof notwithstanding ye Said Ricahrd in his lifetime to witt ye first day of Augt. 1691 he did pay unto ye Said Edw[d. ye Sume] of Seaventeen Thousand Four hundred and Tenn pounds of Tobo. as [o]n ye back of ye [sd. bill e]ndorsed but ye residue being Five Thousand Nine hundred Sixty and [o]ne he ye Said Rich[ard in] his lifetime did not pay nor ye Said Edwd. in his Capacity Since his death that not paid ye Same nor any part thereof nor ye Said Elias Since ye death of ye Said Edwd. in his Capacity have not paid ye Same nor any part thereof tho often demanded ye Same to pay have denyed & refused and Still doth deny to ye Damage of ye Said Edward Baracliff Tenn Thousand pounds of Tobo. and thereupon he brings this Suit Jno Doe Earle pr qr. pleadg &a.
