      But A Copie of ye Decln. being Sent along wth. ye writt and Served According to Act of
Assembly in Such Cases made & provided was as followes Vizt.
Maryland Ss    Thomas Tolly of Kent County Gent. was Sumoned to Answer unto John

   Atkey & Compa. merchants of A plea that he render unto them or theire heires

   &a. ye just Sume of Eight thousand Two hundred pounds of merchantable

   Tobo. in Caske which to them he oweth & from them he unjustly detaineth
And whereupon ye Said Jno &a. by Richard Macklin theire Attry Complaines that
whereas ye Said Thomas Tolly ye 13 day of May 1699 at Kent County within ye jurisdiction
of this Court pr his Certaine writeing obligatory Sealed wth. ye Seale of him ye Said Thomas
and here in Court produced whose date is ye Day and yeare Afsd. did bind himselfe, his
heires &a. to pay unto ye Sd. John &a or theire heires &a ye just Sume of Eight Thousand Two
hundred pounds of good Sound merchantable Tobo. in Casque convenient in Kent County Notwithstand
:ing which ye Said Thomas ye Sume of Eight Thousand two hundred pounds of Tobo. to him ye Sd. Jno
&a. hath not paid altho offten demanded but ye Said Sume of Eight Thousand pounds two
hundred pounds of Tobo. to ye Said John &a. to pay hitherto hath denyed and yet doth deny where
:upon ye Said John &a. Say they are Damnified & have Cost to ye value of Sixteen Thousand
pounds of Tobo. & thereupon bring theire Suite &10 Macklin pr qr.                 Jno Doe       parties

And ye Said Defendt. craves Oyer of ye Condicon of ye Said obligacon and it is read unto him in
these words Vizt. The Condicon of ye above obligacon is Such, that if ye above Bounden Thomas Tolly
doe well, & truly pay, or cause to be paid, unto ye above Named Jno Atkey & Compa. theire heires
Exrs. or certaine Attry ye full Sume of four thousand one hundred pounds of Tobo in Casque at
Some Convenient Landing in ye Creek or Bay Side at or upon ye Tenth day of Octor. next
Ensuing ye Date hereof then this prSent Obligacon to be voyd, & of noe Effect Otherwise to
Stand and remaine in full force, power & virtue
But ye Said Defendt. Thomas Tolly comes into Court in his proper person and Confesseth Judgemt. for
ye Sume of one Thousand foure hundred Sixty & foure pounds of Tobo. being ye balance due upon ye
Said bond and Cost Accrewing upon ye Same
Therefore it is considered by ye Court here that ye Said Plaints. Jno Atkey and Compa. doe recover
from ye Said Defendt. Thomas Tolly as well ye Sume of one Thousand foure hundred Sixty & Two pounds
of Tobo. Debt as alsoe ye Sume of Two hundred ninty and four pounds of Tobo. Cost of Suite and ye Sd
Thomas Tolly in mercy                                                              Jno Dowdall Clk

Comand was given to ye Sherf. of Kent County ye 29 day of Novemr. Annoq Domi 1700 that
he Take Samll. Taylor of Said County Inholder if found in his bailiwick and him Safe keep Soe
that he have his body before his Majties Justices at a Court to be held for our Said County ye
fourth Tuesday of Janry next to Answer unto Jno Hawkins of A plea of Trespass upon ye case
Which next Court being an Adjourned Court untill ye Eleventh day of Febry next
all prcepts were C[ontinu]ed in ye Sherf. Custody untill ye Said Adjourned Court
Att which nex[t Court V]izt ye Eleventh day of February Annoq Domi. 1700 ye Day of
ye returne of Sa[id writt A]ccording to Adjournmt. Came Elias King high Sherf.of Said
County and made [retu]rne thereof in these words Vizt Cepi Corpus      Elias King Sherf.
But ye Said Defendt. Samll. Taylor in his proper person comes into Court and Confesseth
Judgemt. to ye Said Plant for ye Sume of Seaven pounds Seaventeen Shillings & Six pence
Currant money of This Province and ye Sume of Two thousand Three hundred and Seaventeen
pounds of Tobo. Debt & Cost of Suite
Therefore it is Considered by ye Court here that ye Said Plaint. John Hawkins doe
recover from ye Said Defendt. Samll. Taylor as well ye Sumes of Seaven pounds Seaventeen
Shillings currt. money of this Province as alsoe ye Sume of Two thousand three hundred & Seaventeen
