   But a Copie of ye Decln. being Sent along wth. ye writt and Served intuire According
to Act of Assembly in that Case made & provided ye Plaints. Decln.
Kent County    Ss    Henry Wilcock alius dictus Henry Wilcock of Kent County planter was
Maryland
   Sumoned to Answer unto Mecajah Perrey Thomas Lane Richard Perrey


   and John DeBailehashe of London merchants of A plea that he render


   them ye full and just Sume of Twelve hundred Sixty Seaven pounds of good


   Sound merchantable Tobo. & Casque Cleare of all manner of Trash which


   to them he owes and from them he unjustly Detained
And whereupon ye Said plaints. by Richard Macklin theire Attry complaines that whereas ye
Said Henry At Chester River in Kent County within ye Jurisdiction of this Court ye first day
of July Anno Domi. 1699 by his Certaine bill obligatory Sealed wth. his Seale as his Act & deed
delivered and here in Court brought whose Date is ye Same Day and Yeare Afsd. did bind himselfe
his heires Exrs. and Adr. to pay or Cause to be paid unto ye Said Plaints. theire heires Exrs. Adrs. or
Lawfull Attry ye Afsd. Sume of 1267lb Tobo. quallified as Afsd. Convenient Upon ye Said Henry
then Dwelling Plantacon cleare of all manner of Trash at or upon ye Last day of Novemr. then
next ensuing ye Date of ye Same bill yet Notwithstanding ye Said Henry ye Said Sume of 1267lb
of Tobo. According to ye Tenr. of ye Same bill hath not paid but ye Same to pay hath denyed and refused &
           ye Same to ye Said plaint to pay
Still ^ doth deny and refufuse to ye damage of ye Said plaint. 2500lb. Tobo. & thereupon they bring
this Suite                                     Macklin pr qr. pledges &a.                      Jno Doe Rd. Roe
But ye Said Defendt. Henry Wilcock comes into Court in his proper person and Confesseth
Judgt. for ye ballce due upon ye Said bill being three hundred Twenty and five pounds of Tobo and
Cost of Suite
Therefore it is Considered by ye Court here this Day vizt. ye Twelvth Day of Febry Annoq
Domi. 1700 That ye Said plaint Mecajah Perrey Thomas Lane and Richard Perrey and John
De Bailehashe doe recover from ye Said Defendant Henry Wilcock as well ye Sume of Three
hundred Twenty & five pounds of Tobo.Debt as alsoe ye Sume of Two hundred Thirty & Nine pounds
pounds of Tobo. Cost of Suite and ye Said Henry in mercy                 Jno Dowdall Clk

Comand was given to ye Sherf. of Kent County ye 29. day of Novemr. Annoq Domi. 1700
that he Take Hugh Marsh alius Dictus Hugh Marsh of Said County Carpenter and him Safe keep
Soe that he have his body before our Justices at a Court to be held for Said County ye fourth Tuesday
of Janry next to Answer unto Richard Macklin of A plea that he render him ye full & just
Sume of four hundred pounds of Tobo/ which &a.
Which next Court being An Adjourned Court untill ye Eleventh Day of Febry next ensuing
date of ye Same writt
Att which Court vizt ye eleventh Day of Febry Annoq Domi. 1700 ye Day of ye returne of Sd
writt Came Elias King high Sherf. of Said County and made returne thereof in these words
Vizt                                                                             Cepi Corpus       Elias King Sherf.
But ye Said Def[endt Hu]gh Marsh comes into Court in his proper person comes into Court and
Confesseth Judge[mt for ye] Said Sume of 400lb pounds of Tobo. and Cost of Suite
Therefore it is [considere]d by this Court that ye Said Plaint. Richard Macklin doe recover
from ye Said Defe[ndt] Hugh Marsh as well ye Sume of four hundred
pounds of Tobo. Debt as alsoe ye Sume of one hundred and ninety five pounds of Tobo cost
of Suite and ye Said Hugh Marsh in mercy                                          Jno Dowdall Clk
