Sherf. made Answer he had there ready Twelve &a. as by his precept he was Comanded Vizt. Thomas Wyatt foreman Thomas Gwin Edwd. Plestoe George Powell Thomas Ford Jno Jhonson Thomas Browne Nicholas Massey William Robinson Nathanll. Cleave Jno Offley & Jacob Young which Jury being duly Tryed and Sworne and having heard ye pleadings Evidences & Allegacons on both Sides ye Court giveth them theire Charge who withdraw to Consider on ye prmises and After Some time doe againe returne and being Called over as alsoe ye Said Defendt. and being demanded whither ye Said Edwd. Fry was guilty or not guilty as he Stood Indicted Doe Say wee ye Jury Say he is guilty and by Thomas Wyatt theire foreman all of them Soe Say Therefore it is Considered by ye Court here that ye Said Edwd Fry be fined four hundred pounds of Tobo according to Act of Assembly in Such Cases made & provided as alsoe pay ye Sume of Eight hundred forty & nine pounds of Tobo. Costs Accrewing upon ye Said prsentmt. and ye Said Edward Fry in Mercy Jno Dowdall Clk Thomas Tolly being prSented by ye Grand jury last Novemr. for Incontinently living & Cohabitting Together wth. a Certaine Mary O’ Neale wch. prSentmt. was Signed billa vera The Clk of ye Indictmts. moves ye Court & gives them to Understand that ye Kings Evidences are not here and desires that ye Said Thomas Tolly may Enter into Recognizance wth. good Security for his Appearance here at ye next Court & good behaviour in ye meane time which was Granted And Therefore it was Ordered by ye Court that ye Said Thomas Tolly be Comitted into ye Sherf. Custody & there to remaine untill he find Suffitient Security for his Appearance at ye next Court and good behaviour in ye meane while Jno Dowdall Clk But ye Said Thomas Tolley comes into Court Together wth. Jacob Young his Security and ye Said Thomas doth Acknowledge himselfe to owe & Stand justly Indebted unto our Soveraigne Lord King Wm ye Third &a. his heires & Succesors in ye full & just Sume of Twenty pounds Sterg. to be leavied upon his Lands & Tenements Goods and Chattles in Case ye Said Thomas Doe not make his personall Appearance here at ye next Court and in ye meane time be of good a bearance to all his Majties Leidge Subjects And ye Said Jacob Young doth Acknowledge himselfe to owe & Stand justly Indebted unto our Sd. Soveraigne Lord King Wm ye Third &a. his heires & Succesors in ye full & just Sume of Tenn pounds Sterg. to be leavied as Afsd. Condiconed as Above Sd. wherewith they are Content Ordered That ye Sherf. for ye first time he is Amerced pay ye Sume Three Shillings Jno Dowdall Clk Michll. Earle Sworne on behalfe of Thomas Bruff plaint at. John Hollinsworths Adr. Defend[t.] Comand was given to ye Sherf. of Kent County ye 29. day of of Novem[r. Anno D]omi. 1700 that he Take Henry Wilcok alius Dictus Henry Wilcok of Kent County Plan[ter if foun]d in his bailiwick and him Safe keepe Soe that he have his body before his Majties Justices [at a] Court to be held for Sd. County ye 4th. Tuesday of Janry next to Answer unto Mecagah Perrey Thomas Lane Richard Pere[y] and John DeBailehash of London Merchants of A plea that he render them ye full and just Sume of Twelve hundred forty and Seaven pounds of good Sound merchantable Tobo. &a. which &a. Which next Court being an Adjourned Court all prcepts were Continued in ye Sherfs. Custody untill ye Eleventh Day of Febry next following Att which Court Vizt. ye 11th. day of Febry Anno 1700 came Elias King high Sherf. of Said County & made returne thereof in these words vizt cepi co[rpus] pr Elias King Sherf |
