a^t.	last Novem^r. Court for Stealing one guilding of y^e proper goods & Chattles of
[D]an^ll. Pearce	of A Certaine W^m Hollinsworth which presentm^t. was Signed
	Bill of Vera p^r Sam^ll. Wallis foreman
	Which p^rSentm^t. was framed into A bill of Indictm^t. by y^e Clk of y^e Indictm^ts. as
	followes Viz^t.

Kent Ss    The Jurrors for our Soveraigne Lord y^e King that Now is for y^e body of Kent County
upon theire oathes doe p^rSent Daniel Pearce of Kent County alius dictus Daniel Pearce
      Island Hundred in
^ Kent County within y^e jurisdiction of this Court w^th. force & Armes one guilding of y^e price of 95^lbs
of Tob^o. of y^e proper goods of A Certaine W^m Hollinsworth felloniously he did Steale & bare away
against y^e peace of our Soveraigne Lord y^e King and a^st. y^e forme of y^e Act of Assembly in that case
made & provided                                          Macklin p^r Dom^s. Rege

Dan^ll. Pearce	Not Guilty p^r patriam Earle p^r Def^t. And y^e Said Richard Macklin who
ad^s.	followes for our Lord y^e King Sayes he is Guilty Macklin p^r Dom^s. Rege
Rex	Comand was Therefore given to y^e Sher^f. of Kent County that he Cause to come

before this Court Twelve good and Lawfull Men of his bailiwick to Try y^e Isue Joyned To w^ch. y^e Said
Sher^f. made Answer he had there ready Twelve &^a. as by his precept he was Comanded Viz^t.
Thomas Wyatt foreman George Powell Thomas Ford John Jhonson Robert Foreman Edward
Plesto Thomas Browne Nicholas Massey William Robinson Nathan^ll. Cleave Jn^o Ossley & Jacob
Young which Jury duly elected Tryed and Sworne and having heard y^e Evidences pleadings & Allegacons on
both Sides, the Court giveth them theire Charge who withdraw to Consider on y^e p^rmisses and After Some
time doe againe returne and being called over as alsoe y^e Said Prisoner and being demanded whither
y^e Said Prisoner was guilty of y^e Crime he Stood indicted for or not Guilty Doe Say he is not Guilty
and by Thomas Wyat theire foreman all of Them Soe Say

Therefore it is Considered by this Court here that y^e Said Dan^ll. Pearce as to y^e Said Crime goe
thereof w^thout Day he paying his fees                                                    Jn^o Dowdall Clk

Mary Heathcoate bound by y^e Court to James Bruard untill She arive at y^e age of Sixteen Yeares or
day of Mariage And y^e Said James Bruard doth oblidge himselfe to deliver y^e Said Mary one
Cow and one Suite of good new Cloathes when free                      Jn^o Dowdall Clk

Catherine Heathcoat likewise bound by y^e Court to y^e Said James Bruard untill She arive at
y^e Age of Sixteen Yeares or day of mariage And y^e Said James doth oblidge himselfe to give
y^e S^d. Catherine A Suite of new Cloathes when free                      Jn^o Dowdall Clk

Co^ll. Jn^o Hyn[son absen]t but Suddainly Sitts

Walter Smith	[D^t.? Wh]ich writt being Called y^e Said Plaint. by his Said Att^ry Rich^d. Macklin
ad^s	Moves this Court that y^e Said Defend^t. Thomas Prestage may be Comitted into y^e
Thomas Prestage	Sher^f. Custody untill he find Esp^ll. baile to Said Action which was Granted

Ordered Therefore that y^e Sher^f. of Kent County Take into his Custody Thomas Prestage
& there to remaine untill he find Esp^ll baile to Said Action Jn^o Dowdall Clk
And y^e Said Thomas Prestage comes into Court and brings along w^th. him Maj^r. Jn^o Hawkins who becomes
Sp^ll baile to Said Action & promiseth that y^e S^d. Def^t. Tho^s. Prestage Shall pay condemacon if Cast or he will
doe it for him
