at.    last Novemr. Court for Stealing one guilding of ye proper goods & Chattles of
[D]anll. Pearce    of A Certaine Wm Hollinsworth which presentmt. was Signed

   Which prSentmt. was framed into A bill of Indictmt. by ye Clk of ye Indictmts. as

   followes Vizt.
Kent Ss    The Jurrors for our Soveraigne Lord ye King that Now is for ye body of Kent County
upon theire oathes doe prSent Daniel Pearce of Kent County alius dictus Daniel Pearce
      Island Hundred in
^ Kent County within ye jurisdiction of this Court wth. force & Armes one guilding of ye price of 95lbs
of Tobo. of ye proper goods of A Certaine Wm Hollinsworth felloniously he did Steale & bare away
against ye peace of our Soveraigne Lord ye King and ast. ye forme of ye Act of Assembly in that case
made & provided                                          Macklin pr Doms. Rege
Danll. Pearce    Not Guilty pr patriam Earle pr Deft.    And ye Said Richard Macklin who
ads.    followes for our Lord ye King Sayes he is Guilty            Macklin pr Doms. Rege
Rex    Comand was Therefore given to ye Sherf. of Kent County that he Cause to come
before this Court Twelve good and Lawfull Men of his bailiwick to Try ye Isue Joyned To wch. ye Said
Sherf. made Answer he had there ready Twelve &a. as by his precept he was Comanded Vizt.
Thomas Wyatt foreman George Powell Thomas Ford John Jhonson Robert Foreman Edward
Plesto Thomas Browne Nicholas Massey William Robinson Nathanll. Cleave Jno Ossley & Jacob
Young which Jury duly elected Tryed and Sworne and having heard ye Evidences pleadings & Allegacons on
both Sides, the Court giveth them theire Charge who withdraw to Consider on ye prmisses and After Some
time doe againe returne and being called over as alsoe ye Said Prisoner and being demanded whither
ye Said Prisoner was guilty of ye Crime he Stood indicted for or not Guilty Doe Say he is not Guilty
and by Thomas Wyat theire foreman all of Them Soe Say

Therefore it is Considered by this Court here that ye Said Danll. Pearce as to ye Said Crime goe
thereof wthout Day he paying his fees                                                    Jno Dowdall Clk

Mary Heathcoate bound by ye Court to James Bruard untill She arive at ye age of Sixteen Yeares or
day of Mariage And ye Said James Bruard doth oblidge himselfe to deliver ye Said Mary one
Cow and one Suite of good new Cloathes when free                      Jno Dowdall Clk

Catherine Heathcoat likewise bound by ye Court to ye Said James Bruard untill She arive at
ye Age of Sixteen Yeares or day of mariage And ye Said James doth oblidge himselfe to give
ye Sd. Catherine A Suite of new Cloathes when free                      Jno Dowdall Clk

Coll. Jno Hyn[son absen]t but Suddainly Sitts

Walter Smith    [Dt.? Wh]ich writt being Called ye Said Plaint. by his Said Attry Richd. Macklin
ads    Moves this Court that ye Said Defendt. Thomas Prestage may be Comitted into ye
Thomas Prestage    Sherf. Custody untill he find Espll. baile to Said Action which was Granted
Ordered Therefore that ye Sherf. of Kent County Take into his Custody Thomas Prestage
& there to remaine untill he find Espll baile to Said Action       Jno Dowdall Clk
And ye Said Thomas Prestage comes into Court and brings along wth. him Majr. Jno Hawkins who becomes
Spll baile to Said Action & promiseth that ye Sd. Deft. Thos. Prestage Shall pay condemacon if Cast or he will
doe it for him
