Richard Mason      Comand was given to ye Sherf. of Kent County ye 23 day of Sepr
ast.    Annoq Domi. 1701 That he take Samll. Tovey alius dictus Samll. Tovey of
Samll. Tovey    Kent County Smith if found in his bailiwick & him Safe keepe Soe that
he have his body before his Majties Justices at ye next Court to be held for Said County
to answer unto Richard Mason of ye Afsd. County planter of A plea that he render unto him
ye full & just Sume of eight hundred pounds of good Sound Merchantable leafe Tobo. &
Casque which &a.
Att which next Court vizt. ye 25 day of Novemr. Annoq Domi. 1701 ye day of ye returne of
Said writt came Elias King high Sherf. of Said County & made returne thereof
                                                                            Cepi corpus pr Elias King Sherf.
But a Copie of ye Decln. goeing along wth. ye writt & Served in due time According to act
of Assembly &a. was as followeth &a. vizt
Kent County Ss    Samll. Tovey alius Dictus Samll. Tovey of Kent County Smith was
in Maryland         Sumoned to answer unto Richard Mason of ye Afsd. County planter of
                          a plea that he render unto him ye full & just Sume of eight hundred
                          pounds of good Sound Merchantable leafe Tobo. & Casque which to him
                          he oweth & from he unjustly Detaineth
   And Whereupon ye Said Richard Mason by Richard Macklin his Attry complaines &
Sayes that whereas ye Said Samll Tovey ye 23d. day of Octor. Annoq Domi. 1701 At Chester
River in Kent County within ye jurisdiction of this Court by his certaine bill or writing
obligatory Sealed with his Seale as his act & deed delivered & heere in Court brought whose
date is ye day & yeare Afsd. did bind himselfe his heires Exrs Adrs or Assignes to pay or
cause to be paid unto ye Said Richard Mason his heires exrs Adrs. or Assignes ye full & just
Sume of eight hundred pounds of Tobo. quallified as Afsd. to be pd. on his then dwelling
Plantacon on Demand yet notwithstanding ye Said Samll. ye Said Sume of eight hundred
pounds of Tobo. According to ye Tenr. of ye Same bill Obligry unto ye Said Richard he hath not
paid altho offten demanded but ye Same to pay as yet hath denyed & refused & Still doth
deny & refuse & unjustly detaine to ye Damage of ye Said Richard Mason 1600lb. of like
Tobo. and thereupon he brings this Suite       Macklin pr qr. pleadges &a. Jno Doe Rd. Roe
The which Decln. being read & by ye Court heard ye Said Plaintf by Richard Macklin
his Attry prayes that ye Said Defendt. Samll. Tovey would come & make answer to ye Said
Decln. who neither in his proper person nor by his Attry Appearing Judgt. is given
ast. him by Default
Therefore it is Considered by ye Court here this Day vizt. ye 28. day of Novemr
Annoq Domi. 1701 That ye Said Plaintf Richard Mason doe Recover from ye Said
Defendant Samll. Tovey as well ye Sume of eight hundred pounds of Tobo. Debt as
alsoe ye Sume of Two hundred Thirty & five pounds of Tobo. Cost of Suite & ye Said
Samll. Tovey in Mercy ~~~~                      Jno Dowdall Clk

Thomas Cooke    planter if found in his bailiwick & him Safe keepe Soe that he
have his body before his Majties Justices at ye next Court to be held for Said County to
answer unto Edward Stevenson of A plea that he render unto him ye full & just Sume
of Seaven hundred eighty & Two pounds of good Sound Merchantable Tobo. &a. which &a
