116 Novemr. Court 1701 Att which next Court vizt. ye 25 day of Novemr. Annoq Domi. 1701 ye day of ye returne of Said writt came Elias King high Sherf. of Said County & made returne thereof thus endorsed vizt. ~~~ Cepi corpus pr Elias King Sherf. But a Copie of ye Decln. being Sent along with ye writt & Served in due time according to Act of Assembly in that Case Made & provided The Said Defendt. Thomas Cooke by Joshua Sweatnam his Attry appeares & ye Said Cause Standing for Tryall ye plaintfs Decln Kent Ss Thomas Cooke alius Dictus Thomas Cooke of Kent County planter was Sumoned to answer unto Edward Stevenson of A plea that he render him ye full & just Sume of Seaven hundred Eighty & Two pounds of good Sound Merchanta :ble leafe Tobo. & Casque to containe ye Same which to him he oweth & from him he unjustly detaineth And whereupon ye Said Edward Stevenson by Richard Macklin his Attry Saith that whereas ye Said Thomas Cooke ye fourth Day of June Anno Domi. 1701 at Kent County within ye jurisdiction of this Court by his certaine bill or writeing obligatory Sealed with his his Seale as his Act & deed delivered & here into Court brought whose date is ye Same day & yeare Afsd. did bind himselfe his heires Exrs & Adrs. to pay of Cause to be paid to ye Said Edward Stevenson his heires Exrs Adrs or Assignes ye Said Sume of Seaven hundred eighty & Two pounds of Tobo. quallified as Afsd. upon ye Then Dwelling plantacon of ye Said Thomas Cook yet nevertheless ye Said Thomas Cooke ye Afsd. Sume of 782lb Tobo According to ye Tenr. of ye Same bill or writing obligatory unto ye Said Edward Stevenson hath not paid altho offten demanded but ye Same to pay hath denyed and refused & Still doth deny & refuse & unjustly Detaine to ye Damage of ye Said Edward Stevenson 1564lb of like Tobo. and thereupon he brings this Suite Macklin pr qr. pleadges &a. Jno Doe Richard Roe The which Decln. being read & by ye Court heard ye Said Plaintf by his Said Attry prayes that he might have Judgt. for his Debt & Cost of Suite and ye Said Defendt. neither in his proper person nor by his Afsd. Attry Appearing Judgt. is given ast. him by Default Therefore it is Considered by ye Court here vizt. ye 28. day of Novemr. Annoq Domi. 1701 That ye Said Plaintf Edward Stevenson doe recover from ye Said Defendt. Thomas Cook as well ye Sume of Seaven hundred eighty & Two pounds of Tobo.
