Therefore it is considered by y^e Court here viz^t. this 28. day of Novem^r. Annoq
Domⁱ. 1701 that y^e Said Plaint^f Edward Bathurst doe recover from y^e Said
Defendant Dan^ll. Norris as well y^e Sume of Three Thousand Thirty & Seaven pounds
of Tob^o. Debt as alsoe y^e Sume of Three hundred eighty & Three pounds of Tob^o. cost
of Suite and y^e Said Dan^ll. Norris in Mercy ~~~~~~ Jn^o Dowdall Clk

Richard Mason	Comand was given to y^e Sher^f. of Kent County y^e 23. day of Sep^r Annoq
a^st.	Domⁱ. 1701 That he take Nathan^ll. Cleaves alius Dictus Nathan^ll. Cleaves
Nathan^ll. Cleave	of Kent County in y^e Province of Maryland Carpenter if found in his
	bailiwick & him Safe keepe Soe that he have his body before his Maj^ties
	Justices at y^e next Court to be held for Said County to answer unto
	Richard Mason of y^e Same County & Province Afs^d. Planter of a plea
	that he render unto him y^e full & just Sume of Two thousand Six

                     hundred pounds of good Sound Merchantable Tob^o. in Casque which &^a.
Att which next Court viz^t. y^e 25 day of Nov^r Annoq Domⁱ. 1701 y^e day of y^e returne of
Said writt came Elias King high Sher^f. of Said County & made returne thereof thus
Endorsed viz^t. ~~~~~~~            Cepi corpus    p^r    Elias King Sher^f

But a Copie of y^e Declⁿ. goeing along with y^e writt & being Served in due time according to
act of Assembly &^a. which Declⁿ. was as followeth viz^t
Kent County in Maryland Ss    Nathan^ll. Cleaves alius dictus Nathan^ll. Cleaves of Kent County in y^e
                Province of Maryland Carpenter was Sumoned to answer unto Richard Mason of y^e
                Same County & Province Afs^d. Planter of A plea that he render unto him y^e full
                & just Sume of Two thousand Six hundred pounds of good Sound Merchantable
                Tob^o. in Casque which to him he oweth & from him he unjustly detaineth
And whereupon y^e Said Richard Mason by Richard Macklin his Att^ry complaineth & Saith
that whereas y^e Said Nathan^ll. Cleaves y^e 28. day of Novem^r. Anno Domⁱ. 1700 at Chester river
in Said County within y^e jurisdiction of this Court by his certaine bill or writing obligatory Sealed
with his Seale as his act & deed delivered and here in Court brought whose date is y^e day & yeare
Afs^d. did bind himselfe his heires Ex^rs Ad^rs or Assignes to pay or Cause to be paid unto y^e Said
Richard Mason his heires Ex^rs Ad^rs or Assignes y^e Said Sume of Two thousand Six hundred
pounds of Tob^o. quallified as Afs^d. to be paid in Some Convenient place in Kent County Afs^d. at
or upon y^e Tenth day of octo^r. next ensuing y^e date of y^e Same bill yet notwithstanding y^e
Said Nathan^ll y^e Said Sume of 2600^lb of Tob^o. according to y^e Ten^r. of y^e Same bill unto y^e Said
Richard Mason hath not paid altho offten Demanded but y^e Same to pay hath denyed and
refused & Still doth deny & refuse & Unjustly detaine to y^e Damage of y^e Said Richard
Mason 5200^lb. of like Tob^o. & thereupon he brings this Suite                  Jn^o Doe
                                                             Macklin p^r q^r. pleadges &^a.       Rich^d. Roe
And y^e Said Defend^t. Nathan^ll. Cleaves by Michael Earle his Att^ry appeares but y^e Said Att^ry
makeing noe manner of Defence y^e Said in his proper person comes into Court & confesseth
Judg^t. for y^e Said Debt & cost of Suite
Therefore it is considered by y^e Court here this Day viz^t. y^e 28 day of Novem^r Annoq
                                                                  doe recover from the Said Defend^t. Nathan^ll. Cleaves
Domⁱ. 1701 That y^e Said plaint^f Richard Mason ^ as well y^e Sume of Two thousand Six
hundred pounds of Tob^o. Debt as alsoe y^e Sume of Two hundred Thirty & five pounds of
