The which Decln. acct. and plea being read & by ye court being being heard & by ye Court
thoroughly understood & Duly considered Judgt. is awarded for ye Said Debt & Cost
Therefore it is Considered by ye Court that ye Said Plaintf Edward Bathurst doe recover
from ye Said Defendt. Thomas Cooke as well ye Sume of five hundred Twenty & Two
pounds of Tobo Debt as alsoe ye Sume of Two hundred forty & Seaven pounds of Tobacco
cost of Suite & ye Said Defendt. in Mercy ~~~~~~                 Jno Dowdall Clk

ast.    Domi. 1701 That he Take Nathanll. Comegys of Said County planter if
Nathanll. Comegys    found in his bailiwick & him Safe keepe Soe that you have his body
before his Majties Justices at ye next Court to be held for Said County ye 4th. Tuesday of Augst.
next to Answer unto Hugh Marsh of A plea of Assault & battery
                                                                                 To which writt ye Sherf. made noe returne
Comand was likewise given to ye Sd. Sherf. of Kent County ye 26 day of Augt. Annoq
Domi. 1701 That he Take Nathanll. Comegys if found in his bailiwick & him Safe keepe Soe
that he have his body before his Majties Justices at ye next Court to be held for Said County
to Answer unto Hugh Marsh of A plea of Assault & battery
Att which nex Court vizt. ye 23d. day of Sepr. Annoq Domi. 1701 ye day of ye Returne
of Said writt came Elias King high Sherf. of Said County & made returne vizt.

On which Said day ye Said Defendt. by Michael Earle his Attry Appeares and prayes thereof to Imparle
untill ye next Court which was granted unto him ye Same day was given ye Plaintf. likewise
And now here at this day vizt. ye 28. day of Novemr. Annoq Domi. 1701 ye Said cause Standing
                                                                                      defendant by his Attry
for Tryall & ye Said Plaintf. having fild noe decln. ye Said ^ prayes that he might a Nonsuite
which was was granted

Therefore it is considered by ye Court here this day vizt. ye 28. day of Novemr. Annoq Domi.
1701 That ye Said Defendt. as to ye Said Action goe thereof without day & it is further Considered
that ye Afsd. Defendt. Nathanll. Comegys doe recover from ye Said Plaintf. Hugh Marsh as
well ye Sume of fifty pounds of Tobo. for A Non Suite according to Act of Assembly &a. as
as alsoe ye Sume of one hundred forty and four pounds of Tobo. cost of Suite as ye Said Hugh
