Charles Hollinsworth Junr. doe recover from ye Said Defendt. Annoq Domi. 1701 ye day of ye returne of Said writt & made returne vizt cepi pr Elias King Sherf. On which Said day ye Said Defendt. by Michael Earle his Attry appeares & prayes thereof to Imparle untill ye next Court which was granted him ye Same day was given ye Plaintf alsoe Macklin pr qr. And now here at this day vizt. ye 28 day of Novemr. Annoq Domi. 1701 came as well ye Said Plaintf by his Said Attry as alsoe ye Said Defendt. by his Afsd. Attorney and ye Said Cause Standing for Tryall ye Plaintf. Decln Kent County Ss Thomas Cooke of Said County Stands Attached to Answer unto Edward Bathurst In Maryland of A plea of Trespass upon ye Case And Whereupon ye Said Edward by Richard Macklin his Attry complaines & Sayes that whereas ye Said Edward ye Eighteenth day of Augt. likewise on ye 27 day of ye Same month Annoq Domi. 1699 at Ceecill County within ye jurisdiction of this Court at ye Espll. Instance & request of ye Said Thomas Sold & delivered to ye Said Thomas to ye proper use of ye Said Thomas Divers goods wares & Merchandizes Amounting to ye Sume of five hundred Twenty & Two pounds of Tobo. as by An Acct. thereof to this Decln. annexed and here in Court brought ye Same appeares In consideracon whereof ye Said Thomas upon himselfe did Assume & to ye Said Edwd. then & there faithfully promised that he ye Said Thomas when thereunto Afterwards required ye Said Sume of 522lb of Tobo. well & Truly he would pay & content yet notwithstanding ye Said Thomas his promise & Assumption Afsd. made in Manner & forme Afsd. little regarding but Shifting and Intending ye Said Edward ye Afsd. 522lb. of Tobo. Craftily and Subtilly to deceive & defraud ye Said Sume of 522lb. Tobo. altho often demanded did not pay but ye Same to pay altogeather denyed & as yet doth deny to ye damage of ye Said Edward Bathurst one Thousand pounds of Tobo. and thereupon he brings this Suite Macklin pr qr. pleadg Jno Doe &a.
