The which Declⁿ. plea & Acc^t. being read & by y^e Court heard & fully understood & y^e
Said Plaint^f. by his Said Att^ry makeing it Appeare to y^e Court that y^e Date of y^e Acc^t.
was before y^e date of y^e obligacon and y^e Said Defend^t. makeing noe further defence
neither by himselfe nor his Att^ry Judg^t. was awarded for y^e Said Debt & cost

   Therefore it is considered by y^e Court here this day viz^t. y^e 28 day of November
   Anno Domⁱ. 1701 that y^e Said Plaint^f. Charles Hollinsworth Jun^r. doe recover
from y^e Said Defend^t. Peter Peterson as well y^e Sume of one Thousand three
and fifty pounds of Tob^o Debt as alsoe y^e Sume of Three hundred thirty & three
pounds of Tob^o. cost of Suite & y^e Said Peter Peterson in Mercy    Jn^o Dowdall Clk

Edw^d. Bathurst	Comand was given to y^e Sher^f. of Kent County y^e 25 day of
a^st	June Annoq Domⁱ. 1701 That he Take Thomas Cooke of Said
Thomas Cooke	County if found in his bailiwick & him Safe keepe Soe that he

have his body before our Justices at nex Court to be held for Said County to
Answer unto Edward Bathurst of A plea of Trespass upon y^e Case
Which next Court being an Adjourned Court untill y^e 23 day of Sep^r. following
Att which Said Court came Elias King high Sher^f. of Said County being y^e 23
day of Sep^r. Annoq Domⁱ. 1701 y^e day of y^e returne of Said writt & made returne
                                                             viz^t cepi p^r    Elias King Sher^f.
On which Said day y^e Said Defend^t. by Michael Earle his Att^ry appeares &
prayes thereof to Imparle untill y^e next Court which was granted him y^e
Same day was given y^e Plaint^f alsoe    Macklin p^r q^r.

   And now here at this day viz^t. y^e 28 day of Novem^r. Annoq Domⁱ. 1701 came
as well y^e Said Plaint^f by his Said Att^ry as alsoe y^e Said Defend^t. by his Afs^d.
Attorney and y^e Said Cause Standing for Tryall y^e Plaint^f. Declⁿ
Kent County    Ss    Thomas Cooke of Said County Stands Attached to Answer unto Edward Bathurst
In Maryland            of A plea of Trespass upon y^e Case
   And Whereupon y^e Said Edward by Richard Macklin his Att^ry complaines & Sayes that
whereas y^e Said Edward y^e Eighteenth day of Aug^t. likewise on y^e 27 day of y^e Same month
Annoq Domⁱ. 1699 at Ceecill County within y^e jurisdiction of this Court at y^e Esp^ll. Instance &
request of y^e Said Thomas Sold & delivered to y^e Said Thomas to y^e proper use of y^e Said
Thomas Divers goods wares & Merchandizes Amounting to y^e Sume of five hundred Twenty & Two
pounds of Tob^o. as by An Acc^t. thereof to this Declⁿ. annexed and here in Court brought y^e Same
appeares In consideracon whereof y^e Said Thomas upon himselfe did Assume & to y^e Said Edw^d.
then & there faithfully promised that he y^e Said Thomas when thereunto Afterwards required y^e
Said Sume of 522^lb of Tob^o. well & Truly he would pay & content yet notwithstanding y^e Said
Thomas his promise & Assumption Afs^d. made in Manner & forme Afs^d. little regarding but
Shifting and Intending y^e Said Edward y^e Afs^d. 522^lb. of Tob^o. Craftily and Subtilly to deceive &
defraud y^e Said Sume of 522^lb. Tob^o. altho often demanded did not pay but y^e Same to pay
altogeather denyed & as yet doth deny to y^e damage of y^e Said Edward Bathurst one
Thousand pounds of Tob^o. and thereupon he brings this Suite    Macklin p^r q^r. pleadg Jn^o Doe
