The Ex^rs of Londy	Comand was given to y^e Sher^f. of Kent County y^e 25^d. day of June
a^st.	Annoq Domⁱ. 1701 alsoe y^e 26. day of Aug^t. following that he Take
Thom^s. Collins Exe^x	Barbarah Collins alius dictus Barbarah Collins Ex^x. of y^e last will &
	Testam^t. of Thomas Collins late of Said Co^ty Dec^d if found in his

bailiwick & him Safe keepe Soe that he have his body before our Justices at y^e next Court to be
held for Said County to Answer unto James Neale Richard Benett & Phillemon Lloyd Ex^rs of
Henrietta Maria Lloyd who was Ex^x. of John Londey of A plea that She render unto them
y^e full & just Sume of Two thousand and forty pounds of good Sound Merchantable leafe Tob^o.
which from them She unjustly detaines &^a.

The which writt first Issued out was returned    Non Est Inventus p^r    Elias King Sher
Att y^e day of y^e returne of Said Second writt viz^t. y^e 23 day of Sep^r. Annoq Domⁱ. 1701
came Elias King high Sher^f. of Said County & made returne thereof viz^t
                                                                  Cepi corpus p^r Elias King Sher^f
On which S^d. day came y^e Said Defend^t. by Michael Earle her Att^ry and prayes
thereof to Imparle untill y^e next Court which was granted unto him y^e Same day was
given y^e Plaint^f. likewise

And now here at this day viz^t. y^e 28. day of Novem^r. Anno Domⁱ. 1701 came as well y^e Said
Defend^t. by Mich^ll. Earle his Attorney as alsoe y^e Said Plaint^f. by his Afs^d. Att^ry and y^e
Said Cause Standing for Tryall ~~~ y^e Plaint^f. Declⁿ
Maryland    Ss    Barbara Collins Ex^x. of Thomas Collins late of Talbott County Dec^d. was Sumoned
Kent County       to answer unto James Neale Richard Benett & Phillemon Lloyd Ex^rs. of
                          y^e last will & Testam^t. of Henrietta Maria Lloyd late of Talbott County who
                          was y^e Ex^x. of Jn^o Londey late of Talbott County Dec^d. of A plea that She
                          render them y^e Sume of Two thousand & forty & Two pounds of good Sound &
                          Every way well Condiconed Tob^o. & Casque which from them She unjustly
                          Detaines
And Whereupon y^e Said Ex^rs in theire Afs^d. Capacities by Richard Macklin theire Att^ry
complaines that whereas y^e Said Thomas Collins y^e 4 day of March Anno Domⁱ. 1698/9 at
Chester River in Talbott County within y^e jurisdiction of this Court by his certaine bill or
writing ob^ry Sealed w^th. his Seale as his act & deed delivered & here in Court brought whose
is y^e Afs^d. day & yeare didd bind himselfehis heires Ex^rs. & Ad^rs. to pay or cause to be p^d
unto y^e Said John Londey his Ad^rs. or Assignes y^e just quantity of Two thousand & forty & Two
pounds of Tob^o. quallified as Afs^d. convenient in Chester river Upon demand yet nevertheless
y^e Said Thomas in his life time or y^e Said Barbara after y^e death of y^e Said Thomas y^e Afs^d.
Sume of 2042^lb Tob^o according to y^e tener of y^e Same bill obligatory altho often demanded unto y^e
Said John Londey in his life time nor to y^e Said Henrietta Maria Lloyd in her life time nor to
y^e Said Ex^rs nor to either of them Since y^e death of y^e Said Henrietta Maria Lloyd hath not p^d
but y^e Same to pay have denyed & refused & yea Same to render y^e Said Barbara Still Doth deny

to y^e damage of y^e Said Plaint^fs. in theire Afs^d. Capacitys 4000^lb of ^ Tob^o. and thereupon they bring
this Action       And here into Court they bring y^e letters Testamentary of y^e Afs^d. Jn^o Londey
& of y^e Said Henrietta Maria Lloyd whereby it Appeares &^a.                             Jn^o Doe
                                                                            Macklin p^r q^r. pleadges &^a.    Rich^d. Roe
