And ye Said Defendt. comes into Court togeather with James Devergee his Security
and becomes Espll. baile to Said Action and promiseth that if ye Said Defendt. Peter
Peterson Shall pay condemnacon if cast or else he will doe it for him
On which Said day ye Said Defendt. by Joshua Sweatnam his Attry apepares & prayes
thereof to Imparle untill ye next Court which was granted unto him ye Same day
was given ye Plaintf. likewise
And now here at this day vizt. ye 28. day of Novemr. Annoq Domi. 1701 ye Said Cause
Standing for Tryall ye Plaintf. Decln
Kent Ss    Peter Peterson alius dictus Peter Peterson of Kent County in ye Province of
                Maryland was Sumoned to answer unto Charles Hollinsworth of A plea that he
                render him ye just Sume of Thirteen hundred and fifty pounds of Tobo which to
                him he oweth & from him he unjustly detaines
And whereupon ye Said Charles Hollinsworth by Richard Macklin his Attry Saith that
whereas ye Said Peter Peterson ye 26 day of March Anno Domi. 1701 at Kent County
within ye Jurisdiction of this Court by his certaine bill or writing obligatory Sealed with
his Seale as his Act & deed whose date is ye Same day & yeare Afsd. did bind himselfe
to pay or Cause to be paid unto ye Said Charles Hollinsworth or ordr. ye Afsd. Sume of
Thirteen hundred and fifty pounds of Tobo. att Demand yet nevertheless ye Said Peter
Peterson ye Afsd. Sume of thirteen hundred and fifty pounds of Tobo. According to ye
Tenr. of ye Same bill or writing obligatory unto ye Said Charles Hollinsworth hath not paid
altho often demanded but the Same to pay hath denyed & refused and Still doth deny & refuse
and unjustly detaine to ye damage of ye Said Charles Hollinsworth 2700lb of Tobo. and
thereupon he brings this Suite       Macklin pr qr. pleadg &a.            Jno Doe Rd. Roe
But ye Said Plaintf. by his Said Attry prayes that ye Said Defendt. would come and
make answer to ye Said Decln. and ye Said Defendt. by Joshua Sweatnam Appeares
& pleads as followeth vizt
Charles Hollinsworth    And ye Defendt. by Joshua Sweatnam his Attry comes &
ast    defends ye force & injury when &a. and for plea Saith
Peter Peterson    that he have made Satisfaction as by An Acct. Annexed &
are ready to averr and upon this he putts himselfe upon ye Country    Joshua Sweatnam
Charles Hollinsworth Dr. for goods Delivered March ye 28. 1699 lb Tobo
To one blankett & oen bed ½ feathers & ½ flocks 400
To one Table & forme one bell mettle pott qt. 8 gallns 700
To one Tinn Candlestick Two broad hoes & Two narrow howes 90
To 4 qt. bottles 1 pt. bottle & four wooden bowles 34
To one falling ax & one Carpenters Hatchett 50
To one cutting knife & Staple 2 files & A parcell of plaines 54
To a carpenters ads & 3 ½ gallns. Salt & 300 nailes of all Sorts 76
To Coopers compass a flax break 130
To a yeares rent due in 1699 400lb Tobo. on Robert Hudds Acct 400
To five bushells 3 pecks of Indian Corne recd of Sarah Hollinsworth 130
To a hempon bagg Ship carpenters pinchers & one Yeares rent in 1701 1070
