108 Novemr. Court 1701 But plotting contriving and fraudulently intending him ye Said Edward Stevenson in that behalfe craftily & Subtilly to deceive & defraud ye Afsd. Sume of Two pounds nine Shillings & Six pence Sterg. unto ye Said Edward Stevenson ye Said Thomas Tolley hath not paid altho often thereunto required but ye Same to pay hath denyed & refused and Still doth deny & refuse & unjustly detaine to ye damage of ye Said Edward Stevenson four pounds nineteen Shillings Sterg. and thereupon he brings this Suite Macklin pr qr. pleadges &a. Jno Doe Rd Roe And ye Said Plaintf. by his Said Attry prayes that ye Said Defendt. would Answer unto ye Said Decln. who neither by himselfe nor Attry makeing any Manner of Defence Judgt. is awarded for ye Said Debt & Cost of Suite Therefore it is Considered by ye Court here vizt. ye 28 day of Novemr. Anno Domi. 1701 That ye Said Plaintf. Edward Steavenson doe recover from ye Said Defendt. Thomas Tolley as well ye Sume of Two pounds nine Shillings & Six pence Sterg as alsoe ye Sume of Two hundred Twenty and nine pounds of Tobo. cost of Suite & ye Said Thomas Tolley in Mercy ~ ~ ~ ~ Jno Dowdall Clk ~~~~~~~~~~~~~~~ Comand was Given to ye Sherf. of Kent County ye 28 day of March Annoq Domi. 1701 that he Take Peter Peterson alius dictus Peter Peterson of Kent County in ye Province of Maryland if found in his bailiwick & him Safe keepe Soe that he have his body before our Justices at ye next Court to be held for Said County to Answer unto Charles Hollinsworth of A plea that he render him ye full and just Sume of Thirteen hundred & fifty pounds of Tobo. which to him he oweth & from him he unjustly Detaines Att which next Court vizt. ye 24 day of June Annoq Domi. 1701 ye Day of ye returne of Sd. writt came Elias King high Sherf. of Said County and made returne thereof Non Est Inventus Elias King She Comand was likewise given to ye Said Sherf. ye ye 25 day of June Annoq Domi. 1701 that he Take Peter Peterson alius Dictus Peter Peterson of Kent County in ye Province of Maryland if found in his bailiwick & him Safe keepe Soe that he have his body before our Justices at ye next Court to be held for Said County to Answer unto Charles Hollinsworth of A plea that he render unto him ye full & just Sume of Thirteen hundred Twenty & nine pounds of Tobo. which to him he oweth & from him he unjustly Detaines Att which next Court vizt. ye 26 day of Augt. Annoq Domi. 1701 being an Adjourned Court all prcepts were contd in ye Corroners Sherfs. & Constables hands untill ye next Court following Att which next Court vizt. ye 23d. day of Sepr. Annoq Domi. 1701 ye day of ye returne of Said writt According to Adjournement came Elias King high Sherf. of Said County & made returne thereof ~~~~~ Cepi corpus pr Elias King Sherf. On which Said day ye Said Plaintf. by Richard Macklin his Attry moves ye Court that ye Said Defendt. Peter Peterson may be contd in ye Sherf. Custody untill he find espll baile to Said Action which was granted unto him And Thereupon Ordered That Elias King high Sherf. of this County doe keep in Safe Custody ye body of ye Said Defendt. Peter Peterson untill he find Espll. baile to this Action now depending between Charles Hollinsworth Junr. Plaintf. & ye Said Defendt. Peter Peterson ~ ~ ~ Jno Dowdall Clk ~~~~~~~~~~~~~~~ |
