Court 1701 107 Him to pay ye Said Thomas Tolley doth deny & refuse to ye damage of ye Said Edward Stevenson four pounds of like money and thereupon he brings this Suite ~~~ Jno Den Macklin pr qr. pleadge &a. Trespass upon ye Case The which next Court being an Adjourned Court all Actions were contd & precepts in ye Sherf. Annoq Domi. 1701 ye day of ye returne of Said writt According to Adjournemt. came Elias King high Sherf. of Said County & made returne thereof vizt. ~ ~ ~ Cepi corpus ~ ~ pr Elias King Sherf. On which Said day ye Said Defendt. in his proper person Appeares & prayes thereof to Imparle untill ye next Court which was granted him ye Same day was given ye plaintf. alsoe ~~~~ Macklin pr qr And now here at this day vizt. ye 28 day of Novemr. Annoq Domi 1701 came ye Said Defendt. in his proper person as alsoe ye Said Plaintf. by his Afsd. Attry and ye Said Cause Standing for Trayll ye plaintf. Decln Kent Ss Thomas Tolley Stands Attached to Answer unto Edward Stevenson of A plea of Trespass upon ye case And whereupon ye Said Edward Stevenson by Richard Macklin his Attry complaines that whereas ye Said Edwd. Stevenson ye 28. day of Apll. Anno Domi. 1701 at Kent County within ye jurisdiction of this Court at ye Spll. Instance & request of ye Said Thomas Tolley had lent to ye Said Thomas Tolley one peice of eight of ye value of four Shillings and Six pence Sterg. and alsoe at ye like Instance and request of ye Said Thomas Tolley ye 29 day of Apll. in ye yeare Afsd. & within ye jurisdiction Afsd. had paid unto A Certaine John Thrift for & upon ye Acct. of ye Said Thomas Tolley Tenn pieces of Eight of ye value of Two pounds five Shillings Sterg. which Said peice of Eight lent & Tenn peices of Eight lent as Afsd. Amounts in ye whole to ye Sume of Two pounds nine Shillings and Six pence Sterg. as by an Acct. thereof to this Decln. Annexed and here in Court brought ye Same Appeares In consideracon whereof ye Said Thomas Tolley upon himselfe Assumed & unto ye Said Edward Steavenson then & there faithfully promised that he ye Said Thomas Tolley ye Afsd. Sume of Two pounds nine Shillings and Six pence Sterg. when thereunto afterwards required unto ye Said Edward Steavenson would well & Truly content & pay yet nevertheless ye Said Thomas Tolley his promise & Assumption Afsd. little minding or regarding but |
