Him to pay y^e Said Thomas Tolley doth deny & refuse to y^e damage of y^e Said Edward
Stevenson four pounds of like money and thereupon he brings this Suite ~~~    Jn^o Den

And y^e Said Plaint^f. by his Said Att^ry prayes that y^e Said Defend^t. could come & make answer
to y^e Said Declⁿ who makeing noe manner of Defence Judg^t is thereupon awareded for y^e Said
debt & cost of Suite

Therefore it is considered by y^e Court here viz^t. this 28 day of Novem^r. Annoq Domⁱ. 1701
That y^e Said Plaint^f. Edward Stevenson doe recover from y^e Said Defend^t. Thomas Tolley as
well y^e Sume of Two pounds Ster^g. as alsoe y^e Sume of Two hundred Thirty and one pounds of
Tob^o. cost of Suite and y^e Said Thomas Tolley in Mercy ~~~            Jn^o Dowdall Clk

Edward Steavenson	Comand was given to y^e Sher^f. of Kent County y^e 25 day of June Anno
a^st	Domⁱ. 1701 That he Take Thomas Tolley if found in his bailiwick & him
Thomas Tolley	Safe keepe Soe that he have his body before his Maj^ties Justices at y^e

next Court to be held for Said County to Answer unto Edward Stevenson of A plea of
Trespass upon y^e Case
The which next Court being an Adjourned Court all Actions were cont^d & precepts in y^e
Sher^f. Coroners & Constables custody untill y^e next Court following
Att which next Court viz^t. y^e 23. day of Sep^r. Annoq Domⁱ. 1701 y^e day of y^e returne of
Said writt According to Adjournem^t. came Elias King high Sher^f. of Said County &
made returne thereof viz^t. ~ ~ ~       Cepi corpus ~ ~    p^r    Elias King Sher^f.
On which Said day y^e Said Defend^t. in his proper person Appeares & prayes thereof to
Imparle untill y^e next Court which was granted him y^e Same day was given y^e
plaint^f. alsoe ~~~~            Macklin p^r q^r
And now here at this day viz^t. y^e 28 day of Novem^r. Annoq Domⁱ 1701 came y^e Said
Defend^t. in his proper person as alsoe y^e Said Plaint^f. by his Afs^d. Att^ry and y^e Said
Cause Standing for Trayll y^e plaint^f. Declⁿ
Kent Ss    Thomas Tolley Stands Attached to Answer unto Edward Stevenson of A plea of
                Trespass upon y^e case
And whereupon y^e Said Edward Stevenson by Richard Macklin his Att^ry complaines
that whereas y^e Said Edw^d. Stevenson y^e 28. day of Ap^ll. Anno Domⁱ. 1701 at Kent County
within y^e jurisdiction of this Court at y^e Sp^ll. Instance & request of y^e Said Thomas Tolley
had lent to y^e Said Thomas Tolley one peice of eight of y^e value of four Shillings and
Six pence Ster^g. and alsoe at y^e like Instance and request of y^e Said Thomas Tolley y^e 29 day
of Ap^ll. in y^e yeare Afs^d. & within y^e jurisdiction Afs^d. had paid unto A Certaine John
Thrift for & upon y^e Acc^t. of y^e Said Thomas Tolley Tenn pieces of Eight of y^e value
of Two pounds five Shillings Ster^g. which Said peice of Eight lent & Tenn peices of
Eight lent as Afs^d. Amounts in y^e whole to y^e Sume of Two pounds nine Shillings and
Six pence Ster^g. as by an Acc^t. thereof to this Declⁿ. Annexed and here in Court brought
y^e Same Appeares In consideracon whereof y^e Said Thomas Tolley upon himselfe Assumed &
unto y^e Said Edward Steavenson then & there faithfully promised that he y^e Said Thomas
Tolley y^e Afs^d. Sume of Two pounds nine Shillings and Six pence Ster^g. when thereunto
afterwards required unto y^e Said Edward Steavenson would well & Truly content & pay yet
nevertheless y^e Said Thomas Tolley his promise & Assumption Afs^d. little minding or regarding
