On which Said day came ye Said Defendt. by Michael Earle his Attry and prayed thereof to
Imparle untill ye next Court which was granted unto him ye Same day was given ye plaintf. alsoe
The which cause was contd from Court to Court untill this prsent Court
And now here at this day vizt. ye 28. day of Novemr. Annoq Domi. 1701 came as well ye
Said Defendt. by Michael Earle his Attry as alsoe ye Said Plaintf. by Richard Macklin his
Attorney and ye Said Cause Standing for Tryall ye Plaintf. Decln
Kent Ss    Patrick Bryan of Said County Taylor Stands Attached to answer unto Phillemon
                of Talbott County Gentn of a plea of Trespass upon ye Case

And whereupon ye Said Phillomon Loyd by Richard Macklin his Attry complaineth & Saith
that whereas ye Said Phillemon Loyd of ye 27 day of Janry Anno Domi. 1699 at Chester
River within ye jurisdiction of this Court at ye Espll. Instance & request of him ye Said
Patrick Bryan Sold & delivered unto ye Said Patrick divers goods wares & Merchandizes
as by an acct. thereof hereunto annexed and here in Court brought ye Same Appeareth
amounting in the whole to ye Sume of one Thousand Eight hundred & Six pounds of Tobo
Inconsideracon whereof ye Said Patrick Bryan upon himself assumed and unto ye Said
Phillemon Lloyd when thereunto Afterwards required ye Said Sume of one Thousand eight
hundred & Six pounds of Tobo. well & Truly he would pay yet albeit ye Said Patrick Bryan
hath paid and Satisfied unto ye Said Phillemon Lloyd ye Sume of fifteen hundred Thirty and
eight pounds of Tobo. in part of ye Said Sume of one Thousand Eight hundred & Six pounds
of Tobo. yet Nevertheless ye Said Patrick Bryan as to ye residue of ye Said Sume of 1806lb
Tobo. being ye Sume of Two hundred Sixty & eight pound of Tobo. unto ye Said Phillemon Lloyd
hath not paid altho often demanded but ye Said Sume of 268lb of Tobo. residue as Afsd. ye
Said Patrick Bryan unto ye Said Phillemon Lloyd to pay he hath denyed and refused & as yet
doth deny and Unjustly detaine to ye damage of ye Said Phillemon Lloyd 500lb of Tobo & thereup
:on he brings this Suite ~~~~~~            Maklin pr qr. pleadges &a. Jno Doe Richard Roe

Patrick Bryan    defendt. he ought not to mentaine for that ye Said Defendt. Saith that he hath

   paid and Satisfied unto ye Said plaintf. in part of ye Said obligacon in ye
Plaintf. Decln. menconed ye Sume of one thousand Six hundred fifty eight pounds of Tobo. as by
an Acct. hereto annexed and here in Court brought Appeares all which he is ready to aver and
of this he putts himselfe upon ye Country ~~~    Earle pr Defendt.
And ye Afsd. plaintf. by his Afsd. Attry for replicacon Demurs in Law &a. ~~ Macklin ps qr.
The which Decln. acct. Plea and Demurer being read and by ye Court heard and argued
and duly by ye Court considered Judgt. was given by the Court for ye Said plaintf. ast. ye Said
defendt. for ye Sume of Two hundred Sixty & eight pounds of Tobo. and Cost
