Edward Sweatnams Ex^r	And the Said Defend^t. in Said Capacity by Richard Macklin his Att^ry comes &
ad^s	defends y^e force & Injury When &^a. and demurrs in Law to y^e plaint^f.
John Sweatnam	Declⁿ. and y^e acc^t. thereunto Annexed

[1^st] Reason The plaint^f. Saith in y^e yeares 1697 & 1698 which is Eror &^a
2^dly in y^e first article of y^e plaint^f. account he charges y^e defend^t for accomodacons for five months
           at one hundred pounds Tob^o p^r is 500 which is nonsence
3^dly The fourth article is like y^e first incoherent nonsence
4^th The eleventh articule is like y^e first & foarth and for which an action of y^e Case lyes not nor for
           y^e 12 Articule y^e law having provided another remeady in y^e case and likewise for y^e last
           articule in y^e Account ~~~~~~    Macklin p^r Defend^t.

The which Declⁿ. ac^t. and demurer being read argued and by y^e Court Maturely considered
y^e Said reasons were overuled and Judg^t. given y^e Said Plaint^f. for his Debt & cost
he having proved y^e Said Acc^t.

Therefore it is Considered by y^e Court here viz^t. y^e 28. day of Novem^r. Annoq Domⁱ. 1701
   That y^e Said Plaint^f. John Sweatnam doe recover from y^e Said Defend^t. Elias King
Ex^r. of y^e last will and Testam^t. of Edward Sweatnam late of Kent County Dec^d. in his
Said Capacity as well y^e Sume of Three Thousand Ninety & five pounds of Tob^o. Debt as
alsoe y^e Sume of Two hundred Seaventy and one pounds of Tob^o. cost of Suite & y^e Said
Defend^t. in Mercy ~ ~ ~ ~                                     Jn^o Dowdall Clk

Comand was given to y^e Sher^f. of Kent County y^e 13. day of Feb^ry Annoq Domⁱ. 1700 that
he Take Patrick Bryan of Kent County Taylor likewise y^e 28. day of March 1701 That he Take
Said Patrick Bryan if found in his bailiwick & him Safe keepe Soe that he have his body at y^e
next Court to be held for Said County to Answer unto Phillemon Loyd of Talbott County Gentⁿ
of A plea of Trespass upon y^e Case
Att which next first court viz^t. y^e 25 day of March Annoq Domⁱ. 1701 y^e Day of y^e returne
of Said first writt came Elias King high Sher^f. of Said County & made returne Non Est
Likewise came y^e Said Sher^f. y^e 24 day of June Anno Domⁱ. 1701 y^e day of y^e returne of y^e S^d.
Second writt and made returne cepi Corpus            p^r    Elias King Sher^f.
