And ye Said Plaintf. by his Said Attry moves ye Court that he may have Judgt. by
Attachmt. agt. ye goods Chattles Debts rights or Creditts of ye Said Defendt. Edward
Rush which was Granted

Therefore it is Considered by ye Court ye Court here vizt. this 28 day of Novr.
   Annoq Domi. 1701 That ye Said Plaintf. Edward Bathurst have Attachment
ast. ye goods Chattles debts rights or Creditts of ye Said Defendt. Edward Rush as
well for ye Sume Eight hundred Eighty & nine pounds of Tobo. Debt due upon ballce.
as alsoe ye Sume of five hundred Twenty & Seaven pounds of Tobo. Cost & ye Said
Edward Rush in mercy ~ ~ ~ ~ ~ ~                      Jno Dowdall Clk

Comand was given to ye Coroner of Kent County ye 29 day of Novemr. Annoq Domi. 1700
That he Take Elias King of Said County Gentn. Exr. of ye last Will and Testamt. of Edward
Sweatnam late of Said County Decd. if found in your bailiwick & him Safe keepe Soe that you
have his body before his Majties Justices at ye next Court to be held for Said County to
answer unto John Sweatnam of A plea of Trespass upon ye Case
Which next Court being and Adjourned Court all prcepts were contd in ye Sherf. coroner
and Constables hands untill ye 11. day of Febry following
On which day ye Eleventh day of Febry Annoq Domi. 1700 ye day of ye returne of
Said Writt According to Adjournemt. came Thomas Smith one of ye Corroners of Said Coty
and made returne of Said Writt thus Endorsed vizt. cepi pr    Thomas Smith Coronr
On which Said day ye Said Defendt. by Richard Macklin his Attry appeares & prays
thereof to Imparle untill ye next Court which was granted him ye Same day was given
ye plaintf. likewise ~ ~ ~       M Earle pr qr
The which cause was contd from Court to Court untill this prsent Court
And now here at this day vizt. ye 28. day of Novemr. Annoq Domi. 1701 came as well
ye Said Defendt. by Richard Macklin his Attorney as alsoe ye Said plaintf. by his Afsd
Attry & ye Said Cause Standing for Tryall ye plainf Decln.
Kent County in Maryland Ss    Elias King of Said County Gentn. Exr. of ye last Testamt
           of Edward Sweatnam late of Said County Decd. Stands Attached to answer unto Jno
           Sweatnam of a plea of Trespass upon the case
And whereupon ye Siad John by Michael Earle his Attry complaineth & Saith that whereas ye Sd.
Jno in ye yeare of our Lord Christ 1697 and 1698 in Said County wthin ye jurisdiction of this Court at
ye Speciall instance & request of ye Said Edward in his life time did Accommodate divers negroes &
Slaves belonging unto ye Estate of A certaine Richard Sweatnam late of Talbott County decd
and did expend Tobo. in cureing a certaine Negroe belonging to Said Estate of A distemper called
ye yawes and did make or cause to be made for divers Slaves belonging to ye Afsd. Estate divers
Sorts of garments and alsoe did divers pieces of Service for him ye Said Edward in his lifetime
as alsoe expended a certaine Sume of Tobo. in doeing Some of ye Said Services as by A particular
account hereunto Annexed & here in Court brought ye Same Appeares amounting in ye whole
to ye Sume of Three thousand & ninety five pounds of Tobo. in consideracon whereof ye Said
Edward in his life Time upon himselfe assumed and unto ye Said and unto ye Said John
faithfully promised that he ye Said Edward ye Afsd. Sume of 3095lb of Tobo unto ye Said Jno
he would well & truly pay when thereunto Afterwards required yet nevertheless ye Said Edwd.
his promise & Assumption Soe made not regarding ye Afsd. 3095lb of Tobo. unto ye Said John
in his life time he did not pay altho often demanded neither hath the Said Exr. in his Said Capa:
:city Since of ye Said Edward paid ye Same altho often thereunto required but ye Same to pay
hath denyed & refused & Still doth deny and refuse & unjustly Detaine to ye damage of ye Sd. Jno 6000lb Tobo.
and thereupon he brings this Suite    Earle pr qr. pleadges &a.            Jno Doe Rd. Roe
