Kent Ss    Edward Rush Stands Attached to answer unto Edward Bathurst of A plea of Trespass
                upon y^e case
And whereupon the Said Edward Bathurst by Richard Macklin his Attorney complaines that
whereas y^e S^d. Edward Bathurst at y^e Sp^ll. instance & request of y^e Said Edward Rush y^e 22 day
of July Anno Domⁱ. 1698 and untill y^e fifth of Feb^ry in y^e yeare Afs^d. at Ceecill County within y^e
Jurisdiction of this Court had Sold and delivered unto y^e Said Edward Rush divers goods wares
and merchandizes Amounting to y^e Sume of Six hundred and Twenty four pounds of Tob^o. and alsoe
at y^e like instance & request of y^e Said Edward Rush in y^e yeare Afs^d. within y^e jurisdiction Afs^d.
had Creditted a Certaine James Breadley w^th. y^e Sume of fifteen pounds of Tob^o. and alsoe at y^e
like Instance & request of y^e Said Edward Rush in y^e yeare Afs^d. within y^e jurisdiction Afs^d. had
Creditted A Certaine Joseph Hopkins with y^e Sume of five hundred pounds of Tob^o. and alsoe at y^e
like Instance & request of y^e Said Edward Rush in y^e yeare Afs^d. and within y^e jurisdiction Afs^d. had
Creditted A certaine John Read w^th. y^e Sume of four hundred and fifty pounds of Tob^o. and alsoe at y^e
like instance and request of y^e Said Edward Rush y^e 27. day of Octo^r. Anno Domⁱ. 1700 within y^e
Jurisdiction Afs^d. had Creditted a Certaine William Seavery w^th. y^e Sume of Two hundred and
Seaventy pounds of Tob^o. all which goods wares & merchandizes Sold and delivered and y^e Severall
Creditss Afore menconed amount in y^e whole to y^e Sume of one Thousand Eight hundred fifty
& nine pounds of Tob^o. as by an acc^t. thereof to this declⁿ. Annexed and here into Court brought
y^e Same Appeares in Consideracon whereof y^e Said Edward Rush upon himselfe Assumed &
and unto y^e Said Edward Bathurst then & there faithfully promised that he y^e Said Edw^d.
Rush y^e Afs^d. Sume of 1859^lb. of Tob^o. when thereunto Afterwards required would well and
truly content & pay and altho y^e Said Edward Rush hath paid and Satisfied unto y^e Said Edward
Bathurst y^e Sume of Nine hundred and Seaventy pounds of Tob^o. part of y^e Said 1859^lb Tob^o
yet as to y^e residue thereof being eight hundred Eighty & nine pounds of Tob^o. y^e Said
Edward Rush his promise & Assumption Afs^d. little regarding but plotting contriving & fraudlent
:ly intending him y^e Said Edward Bathurst in that behalfe Subtily & craftily to deceive & defraud
y^e Said Sume of Eight hundred eighty and nine pounds of Tob^o. unto y^e Said Edward Bathurst
although Often required hath not paid but y^e Same to pay hath denyed & refused and Still doth
deny & refuse & unjustly Detaine to y^e Damage of y^e Said Edward Bathurst 1779^lb Tob^o and
thereupon he brings this Suite ~~~~~ Macklin p^r q^r. pleadges &^a Jn^o Doe R^d. Roe
