Did bind himselfe his heires Exrs. and Adrs to pay or Cause to be paid unto ye Said
Richard Sweatnam his Exrs Adrs or Assignes ye Said Sume of four Thousand & Eighty
nine pounds of Tobo quallefied as Afsd. Convenient in Wye or Chester River yet notwith
:standing ye Said James ye Said Sume of 4089lb of Tobo. unto ye Said Richard Sweatnam in
his lifetime According to ye Tenr. of ye Same bill he hath not paid nor to ye Said Edward
Sweatnam in his Afsd. Capacity Since ye death of ye Said Richard hath he paid ye Same
neither hath he paid ye Same unto ye Said Elias in his Afsd. Capacity Since ye Death of ye
Said Edward Sweatnam altho thereunto often required but ye Same to pay he hath
Denyed and refused and Still doth unjustly detaine to ye Damage of ye Said Testators
Estate 8100lb Tobo and thereupon he brings this Suite and here into Court he brings the
Letters Testamentary as well of ye Said Richard Sweatnam as well as of ye Said Edward
Sweatnam whereby &a. ~~~~~ Macklin pr qr. pleadges &a. Jno Doe Richard Roe
The Exr. of ye Exr. of    And ye Said Defendt. by Michael Earle his Attry comes & defends ye
Richard Sweatnam    force & injury when &a. and Craves Oyer of ye plaintf Attry power to
ast    Sue &a. ~~                           Earle pr Deft.

The above Said Acct. being proved in open Court by ye Said Defendt. prayed that ye Su[me]
might be Discounted according to Act of Assembly in that case made & provided which gran[ted]
And judgt. given by ye Court for ye Said Plaintf ast. ye Said Defendt. for ye balle.

Therefore it is considered by ye Court here vizt. ye 28th day Novemr. Anno Domi. 1701 that
ye Said Plaintf. Elias King in his Said Capacity doe recover from ye Said Defendt. James
Williames as well ye Sume of one Thousand one hundred Eighty & nine pounds of
Tobo Debt due upon balle. of Accounts as alsoe ye Sume of Three hundred ninety & Two pounds
of Tobo. cost of Suite and ye Said James Williames in Mercy ~~ Jno Dowdall Clk

Comand was given to ye Sherf. of Kent County ye 26 day of Augt. Annoq Domi. 1701 that
he Take Edward Rush if found in your bailiwick & him Safe keepe Soe that you have his body
before our Justices at ye next Court to be held for Said County ye fourth Tuesday of Sepr
next to answer unto Edward Bathurst of A plea of Trespass upon ye Case
Att which next Court vizt ye 23 day of Sepr. Annoq Domi. 1701 ye Day of ye returne of
Said Writt came Elias King high Sherf. of Said County & made returne thereof Vizt.
                                                                  Non Est Inventus    pr    Elias King Sherf.
Comand was likewise given to ye Said Sherf. of Kent County ye 23 day of Sepr. Anno Domi
1701 That he take Edward Rush if found in his bailiwick & him Safe ke Soe that he have his body
before his Majties Justices at ye next Court to be held for Said County to answer unto Edward
Bathurst of a plea of Trespass upon ye Case
The which next Court being An Adjourned Court all Actions were Contd. untill Novemr. Cour[t]
following ~~~~ Att which Court vizt. ye 25. day of Nor. Anno Domi. 1701 ye day of ye return[e]
of Said writt came Elias King high Sherf. of Said County & made returne vizt
                                                                                                Non Est pr Elias King
                                                                                                                    Sherf.
But A Copy of Decln. beeing filld was as hereafter followeth vizt.
